Chase Bank ? - NSF for Returned PDL Checks

I have a question. When a person's checking acct. is overdrawn due to NSF of returned PDL checks, can the bank report you to the authorities? I've never had the kind of problem I'm about to face, and I need to know what to anticipate for. It was never my intention to get into such a mess. I'm so ashamed of myself. :(


First,take a deep breath and relax. Most states do have laws on nsf checks. To indict you on any criminal charges,the D.A. has to prove criminal intent.You did not write a check with intent to not pay it. The pdl ran a postdated check thru probably knowing you couldn't cover it. First,I would make an appt. with the manager of you bank for a heart to heart to explain what happened and to plan how to fix the mess.

Worse case scenario,it is a civil action.If their collectors can't get money out of you,they sue and garnish wages. They would also report you to chexsystems which would make it difficult to open a checking account. We have a moderator on this board that has a huge list of banks that give you second chances if you need that.

One of my storefront pdls had me write out 2 checks @ $371.87 a piece, and their policy is for the checks to be dated the day I took out the loan. They are not post-dated checks. The pdl is Cashland here in Ohio. What do you think the bank would do in a situation like that? I had forgotten Cashland does that.

I previously had storefronts with Cashland and they will deposit both checks. The bank will either pay them if the money is there or they will return them. Cashland will normally call a verify funds before they will try and redeposit. Has the checks already been deposited? If so, you might want to try and call Cashland's collection dept and ask them not to redeposit. They were willing to set up payment arrangements with me. I'm in OH also, so the # to their collections office is (800)773-3147.

When a bank realizing your account has too many NSF charges, they just stop accepting anything in your account and eventually close it. They don't report you to the authorities. You are actually reported to telecheck which can be like a credit report and appear on your report for five years.

This will make it more difficult for you to open a checking account at another bank. However, the companies that have their checks returned to them can turn the check over to the DA's office for the issuance of worthless checks which you can go to jail for but they do give you time to pay for the checks.

Someone named Kevin from this number x3376 keeps calling and leaving messages on my work voicemail for a person I've never heard of. I've been at this number for TWO YEARS and they have been calling on and off that entire time. I have no idea who the person is they are looking for. I finally called the number and talked to the guy and told him I had no idea who the person was he was looking for, that I had been at this number for two years. All he did was keep harassing me that since I am at the same company as whoever he's looking for said they were at that I must know where this other person is. This is round three of doing the same thing. I finally screamed into the phone DONT CALL THIS NUMBER AGAIN and hung up. Hope I busted the a**hole's F*cking eardrum. At least it gave all my co-workers a laugh.
If he continues to call I'm just going to keep calling back and screaming at him. That will stop it eventually ... again. I recommend to everyone getting calls that have no connection with whomever these as*holes are looking for do the same thing. They try to intimidate you. Scream your a** off at them and hang up. And for God's sake don't be stupid enough to give them your name or any other information other than the name of the person they left on the message and the phone number they are calling that's incorrect.
