This despite the fact I have contracted with T&C and have already paid a fortune to these people--more than the original loan amt.

Just a thought, my brother was concerned about someone dipping into his account without his knowledge (think I mentioned this on another thread), but his bank put a type of hold on his account to where he had to let them know when he wrote a check, to whom and how much it was for, plus if he wanted cash, he had to physically go to the bank to get it, and they did not let any automatic withdrawals go through unless he told them what ones were allowed to go through with his permission. Don't know if your bank can do that, but it is worth a try. I know it sounds like a pain in the backside, but might be worth it for a short time, until you can get this cleared up anyway.

There are check revovery systems out there but from the research I just did...all it is is a company that eletronically withdrawls the money if you bounce a check to a store or some place like that...but as far as a collection agency being able to go in and take your money it says nothing of the such....

I got a message from one of their representives the other day. I had a payday loan with them back in March of 2004. I believe that I paid them because I was loaned the money from a relative to pay back all of the loans that I had. Only thing is I cannot find the receipts from the money orders. I have not had any trouble with any of the other loans that I paid off at that time. The representive left a message saying that they are prepared to take action against me. If I don't pay this loan. When I asked him what that action was, he said that I know what that is and if I don't then to ask a lawyer. Matter of fact, he was down right rude and said that he was going to put down that I was going to pay in fulltoday even after I told them that I would not have the money today. What should I do and what actions can they can take?

I find it amazingly hard to believe that is a valid and legal contract under the eyes of the court.I would send a copy of said toiletpaper(contract,yea right!) to your attorney general.Please do remember if they are illegal to loan in your state,I find it really hard to believe that the contract would be enforeable.It would put liability on collector,lender,and check guaranty service for attempting to enforce this.Can you say unlawful/unfair trade practices!FTC and Attorney Generals love those words. Can you say $$$$$$.
