I had a very interesting conversation through email today. It was with the "Compliance Manager" for Emerald Marketing LLC, his name is Jesse Corum. My original Loan was for $300. I'll break it up since it is kinda long...

PART 1
Me: Hey Jesse, I plan on making a payment on the 16th. I just have one question, can you provide me with the total amount of Finance Charges ($90) that I have paid dating back to the date of when I initially received the loan. I want to compare this with my records. Thanks Jesse!

Jesse: You paid 90 on the 15th and 31st of may 06, that’s it. You also sent us a money order for 50 on Aug 29th which went towards you collection status.

Me: Jesse, By California Law there can be no charge for loan "Rollovers" therefore the money that I have paid towards the finance charge should be applied to the original loan amount. Therefore, the balance due should be $70.

Jesse: So pay it!

Me: Once I pay the $70 will I receive a "PIF" notice?

Jesse: Whatever you want.

Me: Is that a Yes?

Jesse: Just send the money

Me: I have no problem sending the money, I am just asking that you confirm for me that my balance due is $70 and once I make the payment on the 16th I will receive a "Paid in Full" notice from Emerald Marketing.

Jesse: NO, you want to pay 70 and close the account pay it today, otherwise keep quoting your laws to try and back out of what you owe. Ball is in your court, 70 today, bye bye account. No money today we'll figure something else out. Thanks

Me: I will pay the $70 on the 16th after I get paid because I can't pay something when I don't have it and this is what we discussed yesterday. I am not sure why the attitude from you but if it continues or I don't receive the "Paid In Full" notice upon my final $70 payment I will be forced to file a complaint with the California Attorney General, because last time I checked, Emerald Marketing LLC was not licensed to do business in California. From what I have read, payday loans are getting so far out of hand that states are more than willing to look into these companies and do whatever it takes to shut down the companies that are operating illegally. I have not had any problems with you in the past and I am more than willing to pay back what I borrowed so it is a shame it is turning out like this.

Jesse: No, your not willing to pay back what you borrowed that is why I am upset. Not to categorize but everybody who gets a loan from us one way or another wants to look not their state laws and find out it may not be the most reputable business but never had a problem with it when you needed the money. Down to the facts: According to the loan agreement you are instructed to pay the finance charges to refinance the loan to the next pay period, not deduct from the original principal of 300.00. So, with the 50 dollar payment you made on the 15th of AUGUST, technically your balance at this point is 250 not to mention late fees that I have withdrawn from the account. 300 is what you borrowed, you made one actual payment ( not finance charge) of 50 to drop it to 250, and you want me to accept 70 and not have any attitude because you believe we are the bad person here. Pay what you want, if you want to contact you atty. gen feel free because we have made more than an outstanding attempt to resolve this debt with you.

Me: If there is nothing wrong with Emerald's Loan contracts and charges then why aren't you guys licensed in California and other states?

Jesse: YOU TOOK MONEY FROM US AND DIDNT HAVE AN ISSUE THEN HUH?

Me: I really hope you never face the situation I was in, and if you only knew what happened I really hope that you wouldn't be talking to me like this. I now know the laws and I am informed on what is legal and what is not. You would be right in what you're saying if I wasn't willing to pay back what I borrowed but I am and you know that. So have a good day and you will receive my payment of $70 on the 16th.

Jesse: My mom just died last Thursday so I could care less what you been through. If you were trying to pay back what you borrowed you would pay 250. But yea I look for your 70 on Friday. Thanks.

Me: Why would I even doubt myself about how much I actually owe when you can't even answer my question of why you guys are not licensed in California and other states? Hmmm, how will you dodge it this time?

Jesse: Dodge what, the payday loan industry is too large to be regulated, yea were not licensed in CA but you didn????????t have an issue with it when you took the money now did you. I????????m done man pay the money or leave me the heck alone.

Me: How was I supposed to know that you guys weren't licensed in California when I took out the loan. Do you lookup every company you do any type of business with and make sure they're licensed?
We would have been done a long time ago if you would have confirmed for me that when I pay the final $70 dollars I will receive a "Paid in Full" notice.

Brodie, Contact your AG IMMEDIATELY> They are not licensed and you need to file that complaint. Dont wait. These AG's cant do anything without complaints. I wouldnt give them a dime without something in writing. The way he was talking to you they are going to take the 70 and run and keep trying to get more. KYSIDE38

I dealt with Emerald Marketing about a month ago. Like everyone else, I took out a loan for $300. When I started having financial difficulties and was unable to pay, they kept hitting my bank account until I had to close it. Then, they came back and told me I owed them ... hold on to your hats ... over $2,500! I used a letter supplied by one of the moderators here in the forum and 2 weeks later, I got a PIF from a guy named Tom O'Donnell. The loan originated with a guy by the name of Roy Sousley. Jesse Corum is their "enforcer". I call him that because he comes across as the tough guy.

Use the resources of this forum and you should be fine. However, DO make sure you report them to your state Attorney General.

Ya, that is correct. I need to get my bank information from my closed account because I am pretty sure I paid more than the two finance charges. Mine was also by Roy Sousley. Before I found this website, everytime I would call them in the past, I would ask for Jesse and they would always say, "oh he's busy speaking with our lawyers right now, how can I help you." I didn't even know the laws at this time and I could tell they were fake and just trying to scare me. Ha ha ha, I am definately going to get my old bank statements and figure out how much I have paid before I give them another dime. I am also filing a complaint right now with the CA AG

Actually, I made them do that for me too. I asked Jesse to provide a full accounting of my loan including any fees they thought I owed them. Then I turned them over to the AG's office. If I had provided what my bank account said it would have been less than half of what they said I owed. But, they have their fees that they add in and the total is outrageous. They came out with such a huge amount owed over a short period of time that it drew instant attention from the AG's office. :wink:

No. The information they provided did not match what my bank statements showed. Actually, they kept hitting my account until they caused it to be NSF. They applied a fee for each attempt on my account. On the other side of that my account was almost $700 NSF by the time I closed it.
