If you got(applied for) a credit card in another state but currently reside in North Carolina. Which state will be the statue of limitation. The last activity was in North Carolina. The credit card debt is currently in collections.


Statute of Limitations is applied on open ended contracts such as the credit cards and other types of debts. SOL is also applied on oral agreements, promissory notes, written contracts, loans, mortgages and car payments as well as foreign and domestic judgments

The Statute of Limitations for legally recovering the debt in North Carolina is 5 years.

Since your account has shown last activity in North Carolina, the SOL period of North Carolina will be considered.

Bankruptcy, Death or Disability: Filing of a bankruptcy tolls the statute of limitations for the enforcement of contracts and judgments.

The death, minority, disability or incompetence of a debtor also tolls the limitation period until such time as a personal representative of the estate or a guardian of the incompetent or minor is appointed

I have servel different cards that I am unable to pat on at this time it has been five years sense I made a payment. Do I still have to pay the balance, or is sol up.

i had a signature loan with this company in 2004. now in 2009 they have turned it over to a collection agency of lawyers. i am in north carolina. Last activity on this account was in 2004. Do they have a case or can i claim NC SOL. I also can not find anything the current account number to which they say this loan is under.
