Oh, I thought it was awesome and stupid on their part. I mean come on, why would you put all that out there for debtors to read. It is teaching them how to be debt collectors, I really learned alot reading it, for me the one that owes the debt, gave me some pretty good tactics on how to handle them when they call. I will keep an eye on this page. Just thought it was real dumb to post that kind of information where anyone could access it. Guess they think we are tooooooooooooooooo dumb.

Actually i don't find it hilarious...it is actually quite educational and quite frankly, good business practices. It is written for 1st party or in house collector. It is meant to be good customer service...however 3rd party collectors could learn quite a bit by reading it.

Ok, guys did not mean to make anyone mad, I have dealt with some pretty nasty collectors, so now when they call, I will be more knowledgeable on how to handle them. I thought it was ironic that someone with such bad manners would put something like this out there. I am being sued by these people. The company they are representing is one of the worst. The girl actually told me that Quote" I would call her crying my eyes out" She was very rude. They have violated several collection laws, it is unreal. Thought is was a very good read, that is why I referred it here. Did not mean it to be hilarious in a funny sense, more hipocritical (sp). They give some real good tips, if they would only follow them or have their clientelle follow them.

Fedup, Wouldnt it be nice if the majority of the debt collectors would just follow the law? I think as long as they continue to get by with it it will only get worse. You are right consumers need to educate themselves to fight back. No one deserves that type of treatment. KYSIDE38

I ran across their publications, I have read over half of them and intend to read more, probably all of them. They hit on some good stuff for consumers to know when dealing with nasty lenders. I am not being a mad debtor here, I offered them what I thought was a fair settlement. They have a card they bought, they want $2800, I know they purchased this old debt for a hell of alot less than that. I offered them, $2000 cash, the original amount of the debt, had it in hand and they refused. They still would have made a hell of a profit taking that. They said no, that is when they sparked my fire to fight. Anyway, it is good reading for all, seriously.

Just read the article on bankruptcy stay and must say I love it. For a creditor to be informed by their own attorney about the illegality of it is great. I also love the amount of sanctions given in that case. This is one reason I tell posters about that procedure.Ca's may violate fdcpa all the time beacause it is so cheap to pay off,but bankruptcy judges take a hard view on anyone violating that stay. They mention case being appealed and I wish them a boatload on that. Very few federal court decision get overturned.

I don't think ANYONE in America should be subject to having their wages or checking accounts garnished.
Above all, a person's primary residence should be totally exempt.
Some credit card companies will issue credit with high limits to most anyone.
Some doing so fully aware the person they issue the card to does not qualify.
Then, when a person can't pay, they turn the accounts over to these collection agencies who have no mercy at all.
When one lends to a person who does not qualify for the card, they should have
to eat the loss.
Taking the money out of a person's checking account aware the person may have checks that will be run through and returned is low.
Then this person who is already in a financial hardship is faced with more hardship.
Kick the person when they are down!!
I have nothing against assets such as second homes, and luxury assets being up for grabs.
However, a primary residence, vehicles that people use to go back and forth to work, pick up their kids, ect., and checking accounts should be off limits.

I don't agree that Collection agencies/Attorneys should be able to garnish, put a lien on your home, or confiscate your vehicle even if the situation is, they are polite & nice, and abide by the regulations.
In the end, if you can't pay the debt, it doesn't matter if they were nice or not.
The person will still have his wages and checking account garnished or a lien put on his home.
Sorry, but I am not for the collection industry or the Laws they are allowed to go by.

When all the money in my checking account is levied and I can't pay my mortgage payment, the least of my concern will be whether the collector was nice.

The idea that a collection agency may be better than other collector's, because they have good suggestions on their web-site,just didn't set well with me.
IMO, they are no better than the rest.
They may not be rude and follow regulations, but they will still push to the limit, and recommend that everything you own be taken, if necessary.

If the Law didn't provide for liens on primary homes:
set the exemption to a standard that allowed a family to exempt a vehicle they depend upon (regardless of it's value):
set an exemption on how much a checking account can be garnished:
based on the account holder's free money after taking into consideration their ability to make monthly payments on their primary home, a dependable vehicle and other reasonable living expenses.
Prohibit garnishment of wages if the debtor earns under a certain amount.
If all the above was introduced into the Laws for collections, there would not be a need for fdcpa regulations.
Debt collector's would then be forced to be polite and courteous and make more of an effort to work with the debtor.
As it is now, they are aware of having the upper hand.
They are aware of having Power over you.

Hey guest, since you have come aboard in a real bad situation you should register. There may be some good advice here for you. We have individuals here that are facing foreclosure, and some who have made it through the process and kept their homes. We welcome anyone who is in a stressful situation, besides your first hand knowledge maybe helpful to some one else.
