Scared Again. PLEASE help with your adice

I just got a call from Check n Go. I took out a loan with them recently, and my fiancee has been paying on another one since last year.

I expalained that I am working with T&C and that I have every intention of paying but that I am just in over my head and needed some help. She informed me that they will not work with T&C because they consider this an "installment loan" and that if I do not remit 363.63 right away, (which I just do not have) they will start collections proceedings and attach my wages. My employer knows about my situation and will not accept any garnishment UNLESS is is court ordered.

Has anyone had this happen? T&C warned me that these companies would tell me that they do not work with T&C, but I am afraid this one means it, since they are legit.

Unfortunately, this was the last PDL that I took before I found this site and started trying to turn my life around, so she she accused me of taking it out nd never intending to pay it back. I swear that's not true! I was 2 car payments behind at the time and still thinking that I could "consolidate" all of my pdl into one more manageable payment. Can I be accused of fraud when I am trying to make payments through T&C. I am not just ignoring all of these bills.

I have never benn in trouble with the law. This is making me sick. I don't know how much more I can handle. Every time I think I have it under control, something else pops up.


On which date will T&C send your payment to Check n Go? Keep in touch with them to confirm that Check n Go accepted the payment from T&C. You need to wait for T&C to send the money if you can't pay them on your own. Don't be scared. Talk to T&C and know if they have worked with check n go in the past. You may get some re-assurance.

Have you paid them anything yet? If you have made some type of payment to them since you took the loan, then they generally cannot claim fraud.

The problem with Check N' Go is that, since they are legal, they probably charge simple (daily) interest. This means every day they are tacking on $3-6 to your balance. That is why they won't agree to T&C- because they don't want to stop the interest. Even if they do take the payments from T&C, chances are those payments won't even cover the interest.

Your best bet is to find a way to pay them off. I know it's easier said then done. If it's any comfort (I know it's not) ... the worst they can do is sue you. You won't be going to jail for fraud.

I am so sorry that a creditor (a loan shark I call them) has scared you so much so that you can't breathe literally.

However, they cannot garnish your wages unless they take the matter to court and only if you don't pay them. I bet that you have talked to them about payment arrangements since they are not going to accept the payment arrangement from T&C. That is the best that you can do and a court looks at things like that.

What I recommend Christine, and I know that this is hard for you because I have been in the same boat, calm down and write them a letter explaining your situation and asking for payment arrangements. Send this letter certified.

These silly creditors don't realize that when they garnish your check they cannot touch the first 75% of your income (at least that is in Louisiana) so they are only going to get a payment. It will be more beneficial to them if you go ahead and pay them yourself directly as it will prevent litigation and the cost of litigation.

If they decide that they want to garnish your wages, they have to go to the court to show why they want your wages garnished. You can send them payments via money orders to pay on your bill. If they don't take the payments, the court will look at this.

Trust me, send them money order payments. They will take them.
