I got a call from a Mike at this company yesterday...He is asking me if I know about the unpaid balance from First National Bank? I said Noooooooo...He said well you had a credit card back in 2000. and your balance is $638.24. Do you remember now? I'm not hmmmm let me see here that was 7 years ago. I was laughing. He's like I can make you a good deal today. If you pay 478.68 by 3/29/07 we will mark your account paid in full and will not update your credit report if the federal reporting period has expired? What does that mean...Anyway, I told him that I needed to see it in writing and he's like we have sent you the letter...I said well I dont know anything or dont remember anything about this...He had my OLD address from way before I was married. I got a fax today from this company about the outstanding balance from a mastercard. There is no date of when I took out the card but I remember him saying it was in 2000. Anyone know the SOL laws for Indiana? I did some research and found it was 6 years but, I'm not for sure. I did some checking on this company and havent found anything good on them....I check some old threads and I checked on "bud hibbs" site and all these people are getting sued! Has anyone dealt with them personally and are they as bad as them seem? I dont want to be sued for 638.24. I just dont have the money until I get paid again for 2 weeks...I have other obligations this week...

Know when you last did the payment on the account with First National Bank. SOL in Indiana is five years from the last payment date. So, there are no worries on this point.

From the date of first delinquency, seven years reporting time will be calculated. Even a partial payment will bring this account back into your credit report and in case you default, all legal collections will be re-enforced.

SOL is already expired on your account. You have no worries because it's least possible they will take you to the court for a debt that will be ruled out by the judge because of expiry of the SOL. Send a dispute letter to the CA mention about the SOL expiry by CMRRR. Keep a copy of this letter and the receipt in safe place. You will need it later in case they take you to the court. You won't get sued if you show all the documents to the judge.

OK- I just got a call from Mike @ midland credit management. I got the final dates of my account I believe is SOL?

The account was opened May of 2000
The last payment was May of 2001


Would someone please tell me if this account is SOL?

This company from what I have gathered has a TON of complaints and I'm a bit leary on sending them money.

Help! :)
