Yes I got many calls from John P Frye Lawfirm. I believe it is a fake company set up for Identity theft. They asked me not only for my bank account number, but my debit access code. I am speaking too my lawyer about it. He also herrassed me even though I was setting up a payment plan. He used foul language and brought up my car payment which he said was a thousand dollars when in all actuality it is only 500 and he then began too downtalk my dad for not paying off my credit cards as well as my car while I am unemployed. If it is a lawfirm in deed they are conducting thereself in an unbusiness like way. Not too mention they got a phone number which is not registered too me. So not only do I feel necessity too take legal action, but the people whom he has offended and reached are talking too lawyers as well. According too a news website they have had in the past 3 years over 100 lawsuits against them.

It is very simple-call his Mechanicsville office and speak to the "real" attorney, Michael Katzen.
Here's how it works-Katzen does the real legal work, Frye diddles the debts. Katzen has had it.
In Roanoke, the "law office" is colocated with Atlantic Credit and Finance. No lawyers there. The only lawyer at the Law Office of John P. Frye is Frye himself.
Tell Katzen he's looking at yet another bar complaint. I did this, he settled for $500 on a $18,000 debt. He knows his license could be taken away for the crap they pull.

And yet Tabby, you still seem to lump it all together.....you are forgetting the one fact: People have the RIGHT to full validation, because it has been shown over and over again that these companies DO charge more interest and fees then is legal, or try to get people to pay using tactics that are downright illegal. You say that if you paid a bill, send in the letter...well what about those debts from 5+ years ago? No one keeps that kind of paperwork around, do you? It is a simple fact that the burden of proof is NOT on the debtor, but on the one trying to collect...they HAVE TO, BY LAW provide the proof. If they state that the interest is legal and in the contract, then they dang well better produce this so called contract. I don't know how many times I have spoke with collectors (and yes, one from Frye office as well) on a couple accounts that were questionable. I asked for the paperwork that is my right and yet they can not provide even a shred of proof. Of course I am going to tell them to stop harassing me. And I do sue them for these illegal practices, and I win...so there it is there.

He represents a bank that purchased an account after it has defaulted he is not the original creditor, which he even states that the original creditor no longer has interest in your money. He is in no position too threaten you with an arrest or state that he can sue you himself,or use innacurate information, or even use foul language which he used with me, and also interrogated me about my dad and provided false information about my car loan which all 3 are against the fair debt collection practices act which was instated in 1978 too protect people against firms like John P. Then let me ask you this. I spoke with someone from JPF, told them I was working with a debt management co. They told me that they do not work with them, then proceeded to tell me that they could work out some payments and I could pay by transferring money from a credit card, borrowing from a bank, etc. I told them that 1) I have no credit cards 2) I have no funds in the bank and 3) My credit is shot right now and I can't even borrow money and have no relatives that could even loan me that type of money. I also told them that CC are the reason I'm in my current situation. I can't believe that they would ask to pay them by using another CC. The other day I got a letter from them stating the same....use a credit card to pay them.

I believe, and someone correct me if I'm wrong, it is a violation of the fdcpa for a CA to request you to borrow money, or in fact incur another debt, in order to pay off a debt. I'm also reasonably certain the old request from a CA for someone to "give us a post dated check" is also illegal.
Also, I would never agree to a payment arrangement with a CA that I know I cannot afford. They will pressure to do so; however, it just causes more problems down the road when you cannot keep your agreement because you cannot afford it.

I had even some of my OCs suggest that maybe I could do a balance transfer to another card in order to pay them. And I had a CA pull a copy of my credit report and tell me that my Chase card was still active and still had room to pay them with it (which wasn't true).

That's what I don't understand. I have cc debt, but they want me to use a cc (if I had one) to pay them.
They made a nice offer with the debt company that I'm working with but my debt company does not do payments. The offer was nice, but I told me Debt company that if I could do it I would but can't. So far, my debt company is working and I'm happy.

I did what the guy said. I called (804) 746-3296 and there are voicemail options for both Frye and Katzen. I left messages. Katzen called back.
He said he was tired of the calls but wanted to work with me. He said he could take $1200 for a $26,000 card debt if I did it in 48 hours.
So I borrowed about $500 and it is on the way. I think this is the way to go. Do not waste time or get heated up with the collectors just talk to Katzen. Katzen said Frye has no idea of what is going on and is never in the office.

This is the worst and hateful people I have ever dealt with. I owe 600.00, and they wanted 400 of it on the 30th of the month. I have been sick, and won't get paid, but they could care less. She said that she would send me out a letter, and I have 5 days to pay it. John P Frye is an attorney. His ENTIRE practice is collecting debt for Atlantic credit. He does no other work, not even collecting for other agencies. Atlantic credit is run by Frye's two cousins. Essentially , Atlantic Credit is not a client of Frye, they are one in the same.
I too read that Katzen is the guy to talk to. He is sick of the crap but has a lot invested in the practice so he settles it for far less money. It looks like a lot of people are just sending him money FedEx without any written deal. Do I need tosay this is a bad idea? It sounds like part of the scam to me. Frye and his bullies piss you off and Katzen comes behinf to clean it all up. Meanwhile they all make a buck on the debt they bought for next to nothing! Be careful. If they sue you, you simply motion to dismiss with prejudice due to it being way beyond SOL. If they threaten to do anything, you have them over a barrel because according to the law, they can't threaten anything they can't do, such as sue and whatnot.

Are usually the ones who "don't pick up the phone"....meaning that they probably aren't aware that if they send the Collection agency a Demand letter requiring them to completly validate your debt...then by law, they must reply..
Debt Collection Defenses
I would send them a "Cease and Decist" letter telling them not to call you. This is your legal right. You can send that typeof letter to any debt collector, even if the guy is an attorney. Then ask for them to send you collection letters through the mail to deal with your debt. This will slow the collection preocess and allow you to file for bankruptcy if you need to.
Pay your bills
JPF i legitimate Law Firm that works in behalf of Atlantic Credit and Finance, and the only reason its been handled by an attorneys office is becouse your original creditor refuse to work with you anymore, you should be mad at them for not telling you they were selling the acct. As per the violations, tell me of one collection office that doesnt have one collector that is overboard, and they usually go out the door, and in regards to them pressuring you more than NCO, well NCO is NOT A LAW FIRM. And yes JPF can sue you if the law permits it. I hope people read this before they talk about things they dont know.

Hi everyone,
So, I have dealt with JPF in the past. I incurred some debt through a CC with HSBC. It went into default and was sold to JPF. I remember (the first time I was contacted by the was 2005 or so) that we made payment arrangements, and paid. We paid for awhile, and then some stuff got in the way... ending in divorce. To be honest, even during the debt-settling talks that my now ex-wife and I had, we never even mentioned this debt.
Then, a week or so ago, I got a call from JPF, saying we hadn't made a payment in 18 months and we had to make one this month. Well, we were both blind-sided. We thought this had been paid off (through a settlement that I thought we had made with them). Thinking on the balls of my feet, I asked them to send a letter verifying the debt. They have done so, but I am sure it is not enough to VALIDATE the debt. I think it is just verification. I think I am going to use one of the templates that I have seen on here to get the debt validated. What does everyone think?
In addition, I am getting multiple calls per day about this, and the number always shows up as (000) 000-0000, so I don't answer it, and they only leave 1 message a day. I think that I want to send a partial C & D letter, but only to make sure that the rest of the communication is in writing.
However, I do NOT want to get myself in more trouble. Would either one of these letters put my file in a different place, labeling me as difficult or "let's sue this guy right away?" I know that sounds stupid, but just curious.
I am willing to pay my debts, but because of the divorce and the fact I don't make enough money, I want to set up a payment plan. I did so in the past with JPF and never had any issues with them taking more money than agreed upon or anything.
Sorry this is so long. Yeah and not to mention all the lawsuits against the law firm for FDCPA and FCRA violations. You make it sound like people purposely are not paying their bills. If they don't have the money you can't get blood from a stone. That is why companies are insured. Nobody owes the law firm a dime. They never did business with the law firm and without proof, you can't collect.

You people have to understand that suing a company for violation of FDCPA isn't much because the individual collector made the decision that the nice check they get is worth violating the law. Usually they are caught and if it is a serious enough offense (degrading, cursing, etc) they will be terminated. It is insane to think that this agency teaches their collectors to violate the law. While they are a CA and they do have a difficult job... they are incorporated and they have attorneys and they must cover all bases, the individual collector can be sued as well.. and they're not going to contribute to the delinquency by teaching things that are illegal. It may be rude to you, but its not illegal, it may be unsympathetic, but its not illegal, they are paid to get the money that you actually owe. You are given thirty days to dispute (fraud, etc) other than that, its cut and dry. Sometimes it sucks, but its life.
