I have an outstanding credit debt from a credit card I ran up when I was in college. I have been ignoring the collections calls for the last few years, and was recently served with papers to appear in court. I called and spoke to the lawyers office that served me. THey said I have until April 25th to pay $6,200 in full. I don't have the money to pay it and would like to avoid going to court at all costs. I would also like to limit the damage to my credit as much as possible. I applied for a few personal loans, but was turned down because of a lack of collateral? Any suggestions of what I can do? Thanks


Have you answered the summons yet? If not, do so as soon as possible, or they will get a default judgement if you don"t appear. You said something about years, how long has it been since you have paid on the debt? It may be out of the SOL period, that doesn't mean you don't owe the debt, just that they cannot sue you for it. But you must include this in your reply, if I am not mistaken..If you have any questions, plesase ask..KAren

Have you checked the Statutes of Limitations on the debt? I would recommend that you answer the summons as soon as possible to avoid a default judgment. I would recommend that you contact the creditor to see if there is anything that can be done to get the debt paid. Either that, or go to court which may or may not recommend a garnishment of your wages. Are you working?

Talk to the collection agency about fixing up a repayment plan for you. Insist them not to take the matter to the court because you are willing to pay as much as you can afford now. If they agree, request them to withdraw the case from the court.

In case, they are not willing to work with you, don't fail to go the court hearing. Otherwise, you will have a default judgment in your name. The collection agency will start contacting your payroll to garnish your wages. When you are in front of the judge, show all your sources of income and necessary expenses. The judge will resize the repayments as per your affordability.
