Hope someone can give me some advice.

I have a credit card debt to Discover. Last week I received a letter from Capital Management Services telling me that they have been engaged by Discover to collect a $8,000 debt. I called up Discover today to see if I can negotiate payment with them directly. However, they told me that I had to set up payment with Capital since they have a contract with them.

I don't trust Capital Mangement from the stuff I've been reading on this forum. Has anyone have any past experience with this compnay?

I know that someone will tell me to do debt validation. However, everytime I request debt validation in the past I get sued. Also, before Capital Management Discover engaged the debt to some other collection agency. I asked this collection agency to do debt validation and Discover is the one that sent me all copies of my old statements. If I ask for debt validation from Capital, wouldn't the same thing happen again?

I am unsure what my next move be? Please help. This is such a wonderful and helpful website. Thank you in advance. God Bless.


You need to know from Discover whether they are hiring the collection agency or the account is sold off. It looks like they are hiring the CA because different companies are getting involved for the collections. If this is the case, then you should be able to work out payment arrangements directly with Discover.

The lady that I talked to today from Discover wouldn't negotiate payments with me. She said they had a contract with Capital Management so I should speak to Capital to set up payments. She also said that Discover will honor whatever payment arrangements I make with Capital.

It seems to me that Discover doesn't want to deal with my account anymore since its charged off. I called back again and discover wouldn't give me any info on it. Do you recommend that I ask Capital for debt validation? Like I previously mentioned, in the past whenever I ask for validation I ALWAYS get sued.

If I don't do the debt validation now and Capital decide to sue me later, is it too late to ask for it then? I am just hoping that the statue of limitatio will expire on this case. Wishful thinking. I know. Thanks again for the advice. I really appreciate it.
