Should I opt out of the binding arbitration clause on my storefront payday loans(Calif.), if I have recently filed for chapter 7 bankruptcy and wish to include them in the filing.What's the best way to not have them collect from my bank account for the May 1st payment--Stop payments?close account?Can I rescind my ACH agreement? Will they still try anyway? thanks, any help is soooooo appreciated.


Okay I don't mind paying it back, just not all at once. How do I stop them from debiting my account for a combined total of 2100.00 on May 1st? Would filing for the bk on them at least make them go into a repayment plan with me?

Once a bankruptcy is already filed, you have to wait for six years before you can file again. So, you have no option unless the case is dismissed.

Is there anyway, you can take help of your attorney and modify the existing plan and include the current lenders? I am not sure about it.

Yes, I can ammend my bk filing to include the payday loans. Whether or not they will be dischsrged I don't know.

But, will it buy me some time, and stop them from debiting my account on the first of May. And then maybe I can do a repayment plan with them?

What do you think about closing my checking account, so I can breathe! This has really taken a toll on me physically and emotionally. My family doesn't know about the payday loan crisis I'm in(including my husband)and everyone is getting frustrated and a little pissy with me, because of the way I'm acting.
