Is this for a student loan?? Allied collects for many guarantors and the USDOE.
What do you mean by harassment?? Are they calling you repeatly to pay your bill??
Student loans can garnish your wages without taking you to court. Give some more information as to what you have done so far to resolve this.

They are threatening garnishment. But they said the same thing last year. I tried to get in a program with them but they screwed up and tried to take two payments out a month. So I stopped the transfers. Now they are calling me again to get back in the "program" to avoid garnishment. Is there anything I can do?

I am certainly not in the same league with soaplady as far as experience...as she was a financial advisor....but, I do know that as long as I had not defaulted on any of my loans I was able to deal with the original lender for rehab and not collection agencies. I simply called the original lender.
So I would suggest if you are not in default....try working out something with which ever lender originally worked with you.
Also, if you are dealing with pioneer who collects for Sallie Mae...be very careful. Because I did enter into a 12 month rehab program with them, and, it was set-up as an auto debit monthly and we never once missed a payment....but they still filed against my tax return and did claim that I had broken the original agreement. And that year they did get our entire refund. But I had been told that if I entered into their rehab that this would not happen...but it did.

You are wrong. You have to be in default to participate in any rehab program. There is no such thing as a rehab for a current loan.

He is working with a CA...he is in default. Original lender will not work with you once you have been assigned to a CA. CA's are never involved if a loan is current.

Again incorrect. Pioneer may be owned by Sallie Mae but they do not collect for Sallie Mae. They are FFELP and DOE CA. When you default against Sallie Mae, they simply sile a claim against your guarantor...they get paid off. Also, the CA has absolutely NOTHING to do with seizing your tax refund. The decision to seize your taxes is done by the guarantor....they place the lien.

CA's cannot guarantee that your taxes wont be seized as they are not part of the decsion making process. Every year the criteria can change.

In order to rehab, it takes 9 months on on time payments. You have to ask specifically to enter the rehab program. Normal payments for rehab are 1% balance. If this is to high, you can ask for REASONABLE and AFFORDABLE payments. This is Federal Law. However they will probably require a full financial statement of all expenses and household income including spouses income if applicable. They may require proof.
What is reasonable and affordable to you might not be to them depending on what is on the financial statement. Fixed expenses such as housing, lights, power and water, daycare, food, vehicle, gas, insurance, reasonable clothing expense and misc. Other expenses such as private school education for kids, high entertainment expenses, even eating out for lunch while working, is considered discretionary.
It all depends on how much you owe. When I was collecting, I had one guy tell me food cost him $1000 per month cause he had to eat all organic. (Our family of 4 was average $500/month). Needless to say that expense was not allowed. A reasonable and affordable plan has to be agreed upon by both parties, so cooperation is important.

When they were taking the 2 payments a month last year you should have contacted them and the student loan ombudsman. Did you discuss this problem with them?? Or just stop making the transfers??

I contacted them and they did nothing about it. Which is why i'm making sure that they take care of that before they see a dime of that 600. Is there anything I can do? I think they righ thand doesn;t know what the left hand is doing. Since Allied has several locations they probably had another location taking out my money seperatly.

Nope. Their is only one student loan office and it is located here in MN. I know one of their collection managers quite well...he was my old boss and now our kids are in the same math class!
If it was a DOE account, I am pretty sure the payment is processed by the DOE Greenville office. FFELP lenders would be processed here in MN.
As I said before you need to call in again and ask for rehab. Demand reasonable and affordable payments. If they REFUSE to negotiate reasonable and affordable, then you have grounds to contact the Ombudsman. Offer a financial statement to qualify. Be persistant. If they refuse, tell them you will contact the Ombudsman office for not following the regs of the Higher Education Act. You basically need to make your attempt credible.
