I owe several payday loans but had to close my account becasue of identity theft. Although I have contacted all of them letting them know that I will pay as soon as I can get things straightened out (I have nothing left since not only the theives have taken everything but the payday folks took the rest...) Most have been pretty good about accepting the fact that I will pay them back. However...
QuikPayday has been calling me at work repeatedly, as in everyday wanting me to make arrangements for repayment, they called me at work today 11 times and even though I told them I would make arrangements as soon as I had the money to do so, they call back wanting something now. I told them to stop calling me at work, and they just keep telling me they'll keep calling until I pay them back in full. I can't even get my paycheck from payroll yet but they won't accept that. I think calling me 11 times in one day is overkill and I told them they were in violation of the FTC and the fdcpa, they claiom that since they are the loan company of origin, they don't fall under those rules. I don't know what to do. I have already filled out the online for you have on this site but no one has gotten back to me, it's been almost a week, I'm at wits end now. I've already dealt with those jerks at Ellis Crosby and haven't heard a peep since but these guys at QuikPayday are relentless.

Welcome to forums. Calling 11 times at work is really objectionable. fdcpa is basically designed for consumer protection. It has some guidelines of debt collection. These guidelines should not be violated at any time.

According to FDCPA neither the collectors can call you at work, nor can they use the telephone repeatedly if you feel disturbed. If they continue with violating these rules you can file a complaint against them and they are obliged to compensate for all the damages they caused. So to proceed legally, you can record their calls which would be a solid proof against their unfair way of debt collection.

Everybody is familiar with the awful activities of Ellis Crosby these days. If you go through this forum, you can get more information about them.

QuikPayday did that to me too and i told them i had filed chapter 7 bankruptcy, even supplied my attorneys name and phone and they said that until i had a case number they would continue to call and email me. They said that they were not a 3rd party collector that the fdcpa did not apply to them. Although they were respectful in all phone conversations and willing to take what ever payment i could afford. They think that they are untouchable.
needless to say i got that case number and email them back and told them that i no longer expect to hear from anyone about this debt. Well actually because i am protected by the federal bankruptcy laws they can not attempt to collect the debt with out violating federal laws.
unless you are able and willing to file bankruptcy or can get involved in a debt consolidation program i would ask them to set up payment arrangements, it has been my experience with this company that they are truly willing.

I went in on August 5th and filled out the requested application information, when no one got back to me I called and was given a e-mail which I used early last week. It was read but I'm still waiting. does anyone ever really get back to us or is this a fake entity?

Hi Pam. this is actually a great place to have all your questions answered. Usually they take half a day to get back to you and most times it's because they are researching your question to provide you with the best answer. I've been posting for a little while, and have nothing but positive results from the answers/advice i've received. :D

Pamster - I am very sorry that you are facing this trouble. Can you please send your mail once again in case if they have not received it earlier? I heard there was one technical problem in the beginning of August as due to some bug.

This type of situation is very rare in this company and they are very committed towards their customers. I hope you will hear from them very soon.

You have the right to tell them to Cease and Desist from contacting you at work. If they continue, they are in violation of the FTC guidelines. Tell them that you will report them. I sent them all a Cease and Desist letter and haven't had much trouble since then.

quick payday called me the other day about their money that i owe them and i didnt answer they called me 6 times after that and not only that they are sending me emails harrasing me telling me if i dont pay them they will be forced to take actions im trying my best to get by with my other bills and they sit up here and harass me i also owe several other payday loan places as well im trying to get all these places off my back and out the way im thinking about changing my number so i dont have to deal with the harassment

These people are ruthless, they will not stop emailing or calling you are work. I filed chapter 7 bankruptcy and gave them my lawyers name and phone and even gave my case #. They refused to stop emailing and calling I got my attorney to fax a letter, stating they are voilating the Federal Bankruptcy Laws and all attempts to collect this debt was contempt of a courts order. That there would be legal actions, should they continue to voilate the courts order. Needless to say I have not heard anything from them again. There are many options for you Consolidation of your debt probably would benefit most, and of course Bankruptcy depending on your indivisual circumstance. Remember Bankruptcy laws change on Oct. 17th, making it harder to file.
Also always file complaints with the BBB, FTC and all the other agencies in these forums.
Remember you dont have to answer the phone!

Has anyone told their boss the situation and asked the company management/lawyers to take action against this company which is abusing their resources? Companies can sue for pretty much anything as long as they are facing financial loss as a direct result of someone's actions. Perhaps if your company's management or lawyer contacted them directly via certified mail or fax they would get the picture. Most of these losers don't fear individuals -- they fear strength in numbers.

Guest - Lenders must conduct themselfs in a professional manner to collect debt. Trying to get someone fired is not legal. You cannot harras someone at their place of employment.

It kills me reading stuff like "Pay it back" when the lender has already paid way more than their original loan in fees and illegal interest. Try charging better interest rates and we will not have these problems.

Amen Glynnie, Guest the reason people come to this site is to seek guidance in taking care of their debt in a manner that allows them to survive. There is not a person on here that wouldn't pay it all off tomorrow if they could.

We appreciate you taking the time to post here, but as a suggestion, perhaps try and see these issues for what they are... often complex, almost always unique and not often cut an dried.

I do agree with Glynnnie and JJ. Lenders should maintain the decorum.

Guest, as you said, they have lent money so they have all the right to get it back. However, people who took the money obviously had some financial crisis! Nobody borrow just out of habit. So they should think twice before harassing consumers.

Guest, browse this forum and you will get immense reason for what people close their checking account. I can remember someone posted in this forum that lenders hitting account before due date and charging NSF fees repeatedly. Is this legal? What kind of business policy is this?

Please understand the problems of consumers also. All are not deadbeats; there are real people who try their best to return the money back. However circumstances play the ultimate game.

Good point Stan and Glynnie. People run into hard times and that does not give the lender a reason to harass the debtor. Also, a little tidbit on Quik Payday. I have been going back and forth with this lender. I logged into my account online out of a whim tonight. I knew they had been in legal trouble in Colorado. It states they are no longer providing loans. Maybe they are close to shutting their doors for good?

What kind of trouble did this loan company get in. I took a loan out with them but I paid it in full and I logged back into my account and it said they are no longer doing loans here in North Carolina.

Their phones are still active, and according to the rep who answered the phone the website is being redone. I think it may be because they appear to have split off into or created another firm that is doing internet based loans in states requiring licenses (I have misplaced the name but I do know that they (the new company) was licensed in Colorado and Washington. The address listed in january was one door down from QP's Utah licensed address.

The good news is at least this company appears to be trying to comply with the law, or at least some of them

quickpayday is horrid! just this past month they decided they were no longer going to loan money and took 400.00 from my account with no notice causing 450.00 in od fees!!!!
