Yesterday I recieved a call from Vanessa with this company, West Asset Management. She says I have been turned over to them for a bill from a local hospital in the amount of $32.39 but if I would be willing to settle at that time they would settle for $16.20. But in order to this they want my credit card info or debit card info. I have NO knowledge of this bill or what it is for. I know this is a small amount and it is NOT on my credit report but how do I know this will be considered paid in full and not re-sold and asked to pay it again and again? I sent out letter of validation already. SO now do i just sit and wait?


I sent them a DV letter about 2 months ago, and never received a response. I still get calls from them, though. Even though I specifically stated in the letter to no longer contact me by phone. All correspondance was to be by USPS. So, when you call them back, TELL them to send you a letter validating what they are telling you by phone. In addition to sending them a DV letter, of course. Let me know how it turns out. :wink:

Yeh, the collection agency is violating the fdcpa laws after mentioned in writing not to call you. Record their phone calls because in Texas, you have the rights to record the debt collection phone calls without notifying the other party. Call the local hospital if you can make a direct payment to them.

Claiming to collect a small debt for half is a clever way to get your account info and take you to the cleaners. Wait for that validation and make darn sure it is real then pay them by money order only.Do not give them any card info or bank info no matter what they say! They won't sue you for 16 dollars. Use the vlidation letter found on this site under "do it yourself". The statute of limitation probably ran out on it if it is real, which I doubt. Old Scam!

Well I sent out the validation letter but this has been bugging me to death! So, I called them back today, which btw, they have been VERY nice. I asked them if I could pay the hospital directly. They said yes I could, gave me the acct number for hospital and said if I pay by the 30th i can pay the reduced amt. Should i still pay by money order? And also, can i put something on the check or money order stating that once cashed the acct is paid in full?
I know this is such a small amount but i dont' wanna pay it 10 times over!

West Asset in Tx. totally ignored my documentation proving I do not owe AT&T 67.12 but in fact they (AT&T) owed and paid me for over payment. West asset has threatened to report their error to the Credit Bureau possibly damaging my re-established credit.
Are there enough damaged people to file a class action suit against them???

the right way to handle any collection agency is with a 15 day constructive notice. when you get a bill from an agency it should be marked in large letters "REFUSED DENIED AND RETURNED FOR FRAUD".
the law is that all parties must consent to contract, if not it is not lawful and is not enforceble. i am not an attorney but have hadmany problems with credit fraud and collection agencies. if anyone would like a more detailed outline or a copy of the constructive notice e-mail to email address removed as per forum rules - Mike and i'll type in the exact format and info you need.

I was send a letter from an lawyer saying I had a judgement againt me but I have never been served. Do I have to be served?The letter said I had 21-27 days to repond. I'm in Texas and I have never used this coming. My credit report shows them on it for 5200.00 as of 8/2007 what does this mean? If it's for the sears account I've been retiered for 8 1/2 years and have'nt made any payments to them as long as I've been retierd. I wonder when I'll be served?

What should I do besides call the county cleerk office?

WTF? Is this a company resurrected from the dead?

I just had my credit card canceled a few weeks ago due to a $950 collection posting delinquent since 5/2008 by this West Asset Management on a Verizon account. I'm in CA and never have a Verizon account since 1993! I reported to the credit agencies and found this WAM was located in 1000 F NO Travis Street. Looking at google maps, there is no WAM office there, it's on some HWY 75? Also I noticed on my report a # of checks by Visa from El Paso TX, which my Visa is from NY. Is this a start of a corporate scam?

They just started calling me, but I never received a letter. I've gotten about five calls so far, and they're from a 757 area code in VA.

I had a Chase checking that got overdrawn by an automatic debit. I lost my job, and was unable to bring the balance down, and I had to wait three months for my unemployment to start. Now they've sold the account to West Asset Management, and they're in for a suprise!

They're getting a taste of their own medicine and don't like it. The last one that called me, I said that I was going to sue them because I never received a letter from them. When I do get the letter, I'm going to send them a Cease and Desist letter, and tell them that I'm going to pay $10 a month on the debt. They can take it or leave it, but they have to respond to me writing with their decision.

On my credit report is a paid collection acount from WAS for a bill from SBC (now AT&T)for $85.00. I never paid WAS for any such bill. The bill was paid to SBC directly in Fed 2005 and they (WAS) placed it on my cr in April 2005. I have contacted them over & over again and the won't remove it and when I dispute it with credit bureaus they verify it as accurate. What do I do now?

wam is a scam. they will take ur acct info and take all of ur money, do not be fooled by them
