I have been in debt with payday loans for a long while and it's eating up my paycheck with all the fees. I can not afford to pay the loans off on the paydate and they roll over. Is there anyone that can tell me about having these loan problems in the state of Pennslyvania?


Pdls are prohibited in the state of Pennsylvania unless the lender is licensed to do business in their state. What companies are you dealing with? And how much have you paid on the principal amount? Chances are that you have already paid the full amount and the IPDL companies are renewing your account illegally.

I'm guessing these are all internet since storefronts are illegal, but if by chance you do have one with advance america (who is currently being sued by PA for it's attempts to get around the law), PA users on this site have found that once you default, the "membership fee" stops . . . .

A couple of these places have called my job and have harassed me and some of my references. I'm so mad about this. Now they try to disquise there real name and give initials out when they call but I know it's them.

I am in Ohio so I can't help with PA laws but I can tell you that Payday Avenue is one of the nastiest places you will ever deal with. I'm willing to bet that they are the ones calling your job and references harassing you, never saying the full name of the company, just saying "PDA." That is what they did to me. I tried to tell them my state's laws and tried to make payment arrangements with them but they wouldn't work with me at all. I complained to my state's AG and they have not responded. They quit calling me after I ignored them for a couple of weeks. It remains to be seen if they resurface, I wouldn't think they would just go away. Oh make sure you send them a letter by email, fax, and certified mail revoking your voluntary wage assignment because they will try to contact your employer and get the money from them. Notify your employer as well so they don't give it to them.

I have been harassed by Payday Avenue calling themselves PDA on the phone. They call my job and my references. I'm so mad about that. I would like to know is this one of the companies that can wage attach your paycheck? I was going to go to the bank and get the papers to stop that from happening and give them to my human resource office. United Cash Loans uses UCL when they call. I stopped payment with them last year because I felt that I was overpaying them. They are still calling and saying I better get a lawyer and ask the local DJ's office about what is the penalty for writing bad checks. Can it be taken that far?

In most cases, defaulting on an internet loan is not criminal, so don't worry. Check your state's laws to be positive.
And demand with PDA that they not contact you anymore and I would do this in writing. Otherwise, they can be sued under the fdcpa.
I also read in this thread that Advance America charges a membership fee in PA? Is that illegal, or what--because they never did it in California!! Sue them!!

Yes, Payday Avenue is the worst. (I was the guest in the above post where I wrote all about them.) They will call themselves PDA. They will try to get your paycheck from your employer. Make sure you tell them in writing that you revoke the voluntary wage assignment and notify your employer of this as well. Do it NOW because they won't waste any time. They are nasty. They called my mother in law and told her I was going to jail for bank fraud. As far as UCL, you cannot go to jail for writing a bad check for a pdl. You never wrote them a check. Let us know how things go.

Thanks for all of the good advice. I will write Payday Avenue a letter to revoke them from trying to wage attach my paycheck and also inform my payroll dept. I just got caught up in the shuffle. I had so many payday loans to pay one off ect. Now I'm dealing with a company called cash call. They have a commercial on tv. So me and my brother applied for the loans and got 2,500 a piece. What they did not tell you is that they are acutally a payday loan company. You have a fee of 216.00 a month to pay that is just there fee. You would actually have to send in extra money to pay the loan off. What a rip off. We were so mad. So we are both in the process of getting money together to pay it off.

Hang in there though. These places are not good and like you had said, you got one then had to get another to pay for the first one and so on and so on. But listen to the advice given. There are a lot of people that have been where you are and have dealt with a lot of the same companies you have. You will get there but it might take a little time, patience and some work on your part, but it will get better. I do recommend closing out your account and opening another one. Sometimes it is better to go to a different bank. I know for us, we got taken by UnitedCAsh loans because they snuck a "check" thru saying I had authroized it, which I didn't. Finially got my bank statments in with a copy of the check and going to see what can be done about it. But stay strong and don't let these people scare you.

I am still being harassed by payday avenue. They just called my human resources office trying to get info on me. I went up there and I was refered to the wage assignment dept. They told me that they will not do that for any kind of payday loan. I was so glad to hear that. I'm going to the AG's office tomorrow and file a complaint about the harassment.

Leashdawg - Cash call isn't a pdl. You pay that $216 a month for like 10 years. So the interest is like a pdl, but the money does go to principle too. Of the $216 you pay, like $.50 goes to principle. It is considered an installement loan, just with super high interest rates. They are also backed by a bank.
