I have faxed a total of 12 letters and the phone calls continue. What can I do?


You have to mail them certified return receipt. If it is only a PO Box than just certified. This gives you proof. Faxes will go right into the floor file. They can't be proven as received by anyone.

Per the fdcpa, a CND letter applies to the original creditor only if the collecting entity presents themselves in a manner that leads the consumer to believe it is in actuality a 3rd party. State laws may apply to original creditors (for example, in California). If are dealing with a bonafide collection agency, and you have proof of delivery, and the calls persist, then look for an attorney on naca.net.
