I've gotten one payday loan marked "paid in full." FINALLY! However, I am still consolidated with T&C and working with them, so far so good. The only thing is I am still receiving calls and emails from some of these companies, mainly Emerald Marketing and the Cash Store. Emerald marketing continues to claim that I am not trying to work out what I owe them, even though I've told them over and over again that they can talk to T&C and I give them their number. But nothing. They continue to threaten me saying they will have my social security number reported if I don't call them and make a settlement before a certain time. From what I understand they cannot do this right?

Here is a cut and paste of the email I just received today........ it is always coming from some "Fran Porter" and they act like I haven't tried to do anything, I told them that I consolidated and I've given them the name of the company that I consolidated with like 10 times! It is crazy!

Well I've already filed a complaint with my AG for a few of these different companies and I told him about what they have sent me but I didn't forward that, ( I hadn't yet received this one when I wrote to him). But he said he is investigating and forwarding my case to another dept who is also helping me out. He does know about this company and has them under investigation. Are they allowed to threaten me like that?

Hi Kim. That email seems like just a scare tactic to me. Fraud investigation on your email address and social security number... They know they wouldn't find any fraud there. If you have this loan in consolidation, I would send a letter to "Fran" (return reciept) telling her to contact the consolidation company and if they suggest that you have commited some fraud, and report as such, you will prepare litigation against them.

Kim,they don't have a leg to stand on for fraud because you are making an effort to pay them. They require a subscription to report to any credit bureau which is very pricy.I would think the only reporting they can get away with is teletrack. They also would not go to criminal or civil court because most of these companies with exception of storefronts business models could not withstand court scrutiny.

No they cannot threaten you with that unless they are actually going to do that but as Cajun said...It woul dnever hold up under court scrutiny! Keep records of everything you have paid them and all their nice little letters...They cannot come after you criminally either

Can someone please email me the information for T&C. Sounds like a lot of people are using them, and I would like to as well. Thanks.

DMS - its been about 20 days since I heard from DMS, and I get this email today:

Quote:

BRAD RAGAN 1-800-859-6439 EXT 370

WESTBURY VENTURES

--------------------------------------------------------------------------------

Unfortunately I can no longer hold on to some cases so they will be released from my possession for further review today . This action could lead to a very significant jump in the amount you owe plus further collection action will proceed in the near future. If you receive this memo, please call me right away to receive an update on the status of your case. Thanks.

If you are aware that your financial situation could be in jeopardy I am now offering to settle your case in full for $350 for the 1st (50) accountholders that make contact by telephone with me today. This payment MUST be wired today ONLY. Otherwise, I am releasing your cases for further collection action.

kind of funny that he's only settling with the first 50 people to call him!! Is that even fair, to offer a 'door prize' of account settlement to the first 50 callers?

i have royally eff'd up this whole quick solution to a long term problem.. Westbury being one, and National Payday Advance being a 2nd... i dont know which is worse.. i paid them out SO much money and now i just refuse to give them anymore. Westbury said i paid one (and only rec'd one) and now i have "another" balance due, yet still strong with the fact i only borrowed one and already paid it... makes NO SENSE. i have filed SO many complaints and i am sure nothing will happen with them, but that terminology seems to keep them at bay for a short period of time...

FYI - i pulled my credit today, NONE OF THEM ARE ON IT.... NOT ONE. and i had a BUNCH of them... they have their own twisted system that if u apply for a pdl, and these various companies have u "marked" u prob couldnt get approved (and who would want to after all this!)...
