Out of all the companies you are dealing with, you need to be careful of those who are having a legit business. The unlicensed companies won't go to the court and make a claim because they will have a fear of being caught for running an illegal business. Check for the companies that are licensed in your state.

Thanks, Trenity....I know the only ones licensed are Cashland and Cashnet USA. What do I have to be careful of? Should I be worried about them filing a claim? I mean I don't care if they file one...but can they do something to me for filing?

Sass, I asked you to be careful of the licensed companies because when they come to know that you are filing for bankruptcy, they may want to recover their money by any means. For this, they might be quick in taking to the court and get a judgment against you before you have filed for bankruptcy. Once the papers are filed, they don't have much to do.

Judgements are dischargeable in bankruptcy and if she is quiet until it is filed, then the bankruptcy stay is enacted. If they continue once the stay is ongoing, let me know so we can find you an attorney and make some serious money.

Correct, look into the costs also. It will double; one for the debts and the other for the judgment if it happens. We need to think something so that Sass doesn't have to pay anything extra.

I was thinking about filing and told United Cash that I was thinking of doing that, they just told me to let them know if I did, they didn't say what they would do if I did file.

Thanks for the input everyone. Actually UCL is the one company that I did call already-the reason I called them is because I need to know how much they say I owe them so I could claim it on my bankruptcy-plus I was feeling them out about my complaint to the AG. They didn't seem to care and just said they would continue trying to collect until they had my case #. I guess I am going to have to call all these places ahead of time to find out how much they say I owe so I can claim it, is that correct? I hate to have to pay them when I don't legally owe them anything. I don't want them to push for lawsuits before the bk is filed but the only 2 I think would do this is Cashland and Cashnet USA and I am not calling them because I already know how much I owe them. I have a feeling some of these places will still hassle me during the bk stay then we will have to go after them cajun! You all are wonderful and I appreciate you taking the time to answer my questions!!!!! Don't stop there---keep going if you have more to add please!!! I don't know too much about this chapter 13 and pdl's. I filed a chapter 7 before.
When you file your petition, you don't need to know exact amount
When you file your petition, you don't need to know exact amounts -- you can simply put the principal balance down as the amount owed.
After you file, the court will send a notice a filing and a claim form to each creditor that you list in your petition. It is up to the creditor to fill out a claim stating how much you owe, and they also need to submit supporting evidence to back up their calculation. If they are charging you gob-loads of interest that you don't think is legal, you and the trustee can object to their claim.
As long as you include them, once you file there is nothing they can do to further collect on the loan. If they call or or try to debit your bank account, they can get in big trouble.
