No they cannot do this to you. But I will tell you that they will keep calling your employment and making the same threats. You need to tell your employer the situation and if they call your employers is to tell them no they cannot do that and to stop calling.
I finally got them to stop calling me by chewing them a new one because they called my home at 7:30 am and I told them that, that was illegal and I am not going to pay them a dime until they send me something in writing. They wanted me to tell them my info. I said you already have my info so go look at it then send it in writing and do not call until you do. I also told them that my state was investigating them because I had made complaints to the state AG, the state DFI and the FTC about what they have done.
DO NOT give them your credit card info!!!!! Make more complaints to your state like the Department of Financial institutions and the FTC.
Did you default on a internet payday loan? That is where this came from,I believe they are a CA for defaulted loans.
They want you to be scared. They use that to get people to pay them. Don't be scared and stand your ground and demand something in writing.

I wonder if I should even bother answering my phone when all these collection agencies start calling. Bubblefan - Just know that it's all lies that they are telling you. If you don't think you can handle the phone calls, then by all means, don't answer the phone. They can get very nasty. Be aware that they will call your employer and any references that you put down on the application, so you may want to warn anyone that they may call.

Do not even take them seriously. Just laugh at them and hang up but do inform your employer and your refs of their illegal harrasment. Making terroristic threats is a felony punishable with prison time. Tell them this. 941 is Western Florida and 908 is Central NJ. I happen to be from both those places. It is not me who is calling you however. No one is going to come to your job because they know they would be arrested for criminal trespass. Remember, they are the bad guys not you. You have not broken any laws. They have. When they realize that they can't intimidate you they will leave you alone. They are probably calling from India, not the US. All they can do is threaten.

Just got a call from them on my cell phone. They told me the office from our local police dept. called them last night....and then they said they were sending someone to "get" me right now. I asked them for something in writing stating I owed a debt and they said that when a loan was taken out, I agreed to not see anything in writing. They have not called my employer yet as far as I know....am extremely concerned that this could ruin my reputation here, especially if they call and get one of my employees- rumors will fly....they haven't called my extention today yet, but suppose they could have called other people... This just flat out sucks! Does anyone know how long iut will be before I can expect to hear from the Atty General on teh complaint I filed on them?

I don't know about that, but I would call them back, tell them you just talked to the police, and in fact no one is coming to arrest you, and that the police told you that it could never happen, and that it is illegal for them to threaten you like that. No problem . . . . I would still be concerned about them calling your work and talking to other people. These people have no consience about telling anyone who they get on the phone the same lies they are telling you. If at all possible, I would warn people at your work. It's better to make up some story about someone stealing your identity and taking out some crazy loan and now this company is calling and harrassing you about it then having them think you are really going to be arrested. I know it's not good to lie, but you don't want to lose your job or co workers respect because some illegally operating company is breaking the law.

They still called day after day until the receptionist finally told them my company had filed a police report of harrassment against them. The calls finally stopped, but that was after 2 months of repeated calls.

Guest, sounds like you have a very good case, with evidence including a police report. 1) they said you were going to jail, 2) suggested you'd committed a criminal act, 3)"threatened to ruin your credibiltity and career"... I'd be taking them to court if I were you. Sounds like the entire call was made up of violations of the fdcpa.

You need to read over the Fair Debt Collection Practices Act. Just Google that and it will come up. If this company is in fact a collection agency, they are bound by the fdcpa. And believe me, they are in deep doo-doo. If you have an address, send them a letter CRRR telling them to stop their illegal actions. do not be afraid to quote sections of FDCPA. Tell them to:
Stop the threats
Stop the harrassment
Do not call your work
Cease and desist all contact with you
Inform them if they do not, you will sue them and it will cost them at least $1000 per violation.
Then notify the BBB where they are at, as well as filing a complaint with the FTC and their state AG. Get forceful and they will back off.
