Need help with Ellis Crosby Assoc.

Hi,
On 8-15-05 at about 2 o'clock in the afternoon I received a phone call from a Steven Price that claimed to be an investigator. He told me that this conversation was being recorded. He stated that I took a $200.00 loan out with ecashnow. Then he told me that if I did not pay $605.00 by 4 o'clock my time that the law enforcement will then come and detain me. So he stated that I needed to get a lawyer. Yes I did take out an loan for the amount of $200.00, but they are trying to get $605.00 from me. He pull up a criminal report to see if I criminal recorded and I do not. so he said that they can take 2 payments of $302.50 and I would have to come up with the 302.50 by 4 o'clock today. If I didn't come up with the money or call him back then they would assume that I would run from this and get me detained with the law enforcement. The phone number that he had given me is 800-491-8615 ext:227. I called the number and the company is Ellis Crosby & Associates. Is this an collection agency? And do they have the right to threaten you like that? Also will I really get detained and go to jail over $200.00? Please let me know what I can do about this?

Please don't get worried about this collection call from Ellis Crosby. This company is a collection agency and its membership has been suspended. They are involved in such illegal activities like threatening with jail, committing fraud etc..

Please read this forum elaborately and you will be able to handle them without fear when they call you next time.

Also, it is not necessary for you to start paying to them as they are undergoing legal surveillance. Be assured that they will not take any action against you.

At this point I think it doesn't matter who is calling you from Ellis Crosby because I think they keep changing their names. They are acting as lawyers and threatening to arrest you when they are only collection agencies. I got a message the other day from Ellis Crosby. They threatened me to come up with the money within 24 hours or they would have a warrant for my arrest. I told him..."I would have to be served with papers first. you never attempted to ever mail me anything." I had my legal counselor call back to them and they were so rude to her that they refused to talk to her when she said she was recording the call and said she would have to call them back. she said, "no! you call me back and they said no you call back." if these people from ellis crosby were even a little bit legit they would call you back. the fact is they act all tough with legal terms that the minute you get legal with them they get so scared they back off.

i recently spoke with the attorney general's office and they said ellis crosby is under investigation and they are only a collection agency and have no legal rights at all to serve anyone with a warrant for an arrest. they are just trying to scare you. remember they can't stop calling you to collect a debt but they have to stop harrassing you. tell them to send you a bill in writing of the debt before you pay anything to them and also make sure you get a bill from your prior payday loan company.

also they have no legal recourse as long as you are making payments. so tell them you will mail a money order for $20 a month and send it via certified mail. if they refuse your money and ever attempt to take you to court you can show the judge the you were willing to pay but they would not accept your money.

Sending them $20 is the worst thing you can do. They will call you harass you more and tell you they are sending it back and say " WHAT ARE WE SUPPOSED TO DO WITH $20"?
These people probaly got hired from the parol bin!!!
I mean come on! I am waiting for their call agian, so I can tell them Go ahead call my boss, he is a lawyer and he will eat you up!

Welcome to the forums. It is not necessary for you to send any money to Ellis Crosby at this point of time. You should ask for a debt validation letter before you wish to enter into any type of payment with them. If you send the money to them, then your Statute of Limitation period will be changed and it will thus appear in your credit report for a longer period.

Debt validation is your legal weapon by which you can ask the collectors to produce the complete details of your accounts. They will have to include the following information in your debt validation letter so that you come to know about the accuracy of it.


  • The details of the account.

  • All the calculation should be shown of the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • Provide a verification or copy of any judgment if applicable

  • The original creditor needs to be identified.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

Until and unless they have validated your debt, you are not legally obligated to pay them.

If they keep on calling you after not validating the debt, it is a violation of the fdcpa law and you can take legal action against them as per the Consumer protection afforded by the FDCPA, Section 809 (b) and sue them up to $1000.

You can record all the telephonic conversation and inform them that you will be presenting it to your lawyer. Most probably, they will stop calling you further.

it was easy to get them to stop harassing me, all they did was call me 2 times threaten me and I told him that everytime they call i get all upset and from there he was nice. Never heard back form them
