Loan Point USA debiting money. Should I file a complaint with AG?

i need to file a complaint with the AG somewhere. I have found them in Utah, Oklahoma, New Mexico, Delaware, Kansas and more. I can't file a complaint in every state. Loan Point USA people refused in writing to stop ACH withdrawals after I told them there was no money in the account due to an interruption in my direct deposit from work. They tried three time each payday for months even after I had the account on deposit only. I also had already paid them way more than the Florida laws permit before this happened.
Why do I keep getting logged out?

Unfortunately, you have to take this hassle and report Loan Point USA illegal business to your attorney general. Tell them that they are trying to deduct money from your account even after the loan is paid in full as per the Florida laws. They need to be investigated fast. Check with your bank if they are charging any NSF fees. You need to get it reverted.
Loan Point USA - what to do?
Unfortunately the Florida AG told me, when I filed a complaint against Route 66 Funding that there was little that they could do because they are in a different State. They suggested I file in that state. They were based overseas and only had call centers in this country. I doubt any solution for Loan Point USA too.

Payday lenders like Loan Point USA have to abide by the state laws of the consumer they are lending too UNLESS you are in a state that has a loophole in the law such as PA

AG can't help with ipdls like Loan Point USA
My AG will not pursue out of state internet PDLs I guess because it is too costly. They say to file in the state the company is located in. I am also filing with the OCC and the FTC. I am determined to get Loan Point USA for refusing to stop ACH withdrawals after my account got screwed up by my payroll company. I have there refusal in writing. I am really just trying to find an address for Loan Point USA. I did find out that they are operating under Utah banking laws. So I will start with Utahs AG.

You're better off filing in Kansas. Geneva Roth is located at 1923 FOXRIDGE Drive, Kanasas City, KS. The owner's name is Mark Curry, the same guy listed as the owner of LoanPointUSA. Even their Utah license says they make loans from the Kansas address. Geneva Roth charges twice the legal rate in Kansas assuming they were licensed and Kansas law says a lender forfeits the principal and has to pay two times the interest it collected in penalties when it violates the usury laws.

Loan Point USA use multiple addresses. But when I searched the corporate records for LoanPoint and Geneva Roth the Foxridge Drive address and "Mark Curry, President" kept popping up.

Actually, I just copy of the AG complaint for CA that Langhorne Law just filed for me (thanks, Dennis W if you're reading this!! :lol: ) and he used Foxridge Drive, so I guess that is where Loan Point USA are.

Letter to Loan Point USA aka Geneva Roth
My last post just went into cyberspace for some reason.
I filed against them with the AG in Kansas, the AG in Florida, the FTC and the BBB in Kansas. The BBB had the listed at the Shawneee address. I will send a letter to Mr. Curry at the other addresses as well.
Loan Point USA have taken 360.00 against a 200.00 loan and like I said refused to stop when I told them to when I was overdrawn. I am going after them fotr the interest and all the overdraft charges. I am glad I live in Florida which is a non garnishment state. That will keep ther retaliation option to a minimum I hope.Thank you all for you help. Kansas AG nice to file complaint against Loan Point USA
The Kansas AG is good. The y ask immediately for you to forward supporting documentation to them. I am semding them a bank statement that was printed from a "search by Debit amount" list that shows all there attempt up until the account was frozen and then the mailed notice that came afterward as they still continued. I am going to suggest in my letter to the Kansas AG that Loan Point USA consider filing criminal charges with the US Attorney if they see fit. Can't hurt.

That would be a good idea. It surprises me that these outfits (Loan Point USA and Geneva Roth) can operate anyway they want and get away with it. I think it is the "cost to pursue" factor that keeps them going. Some of them weave such a tangled web by using multiple names and moving all the time. Geneva Roth says in their Loan Point USA web site that they operate under the laws of Utah but yet they are located in Kansas.

You do have a point. At some point, you have to weigh the cost of the actual debt versus the cost to pursue, as you've stated. But with the internet, I do know you can pay for a background check at a moderate cost that should give this information. Either that, or it's a long Google search.

I actually meant the cost for a law enforcment agency's legwork and lack of manpower to pursue accross state lines and even overseas. If GR has a call center in Kansas but actually is licensed in Utah all the AG can do is slap the wrist of the call center with a fine and possibly shut them down. GR will just open up somewhere else as they apparently have done in the past. Thats why we need federal laws enforced against these people.

What is the loophole in the state of PA in regard to payday loans and license? i have a loan with geneva and my attorney said they are not lic in the state of PA and operating illegally without a license - he told me they are not lic in teh state of PA and can't collect funds in my state or issue them? thoughts?

The Dept of Banking (they do the work and not AGs office here) called them up and reminded them they are not licensed and suddenly the remainder I owe them on the principal $210 is a good offer. So please pay them back the principal amount that you borrowed.

Wait a minute! From what I understand regarding pdl law in PA, if the pdl is licensed SOMEWHERE, PA recognizes the pdl and you have to abide by the pdl law of the state where the pdl is located. They do not have to be licensed in PA. They have to be licensed SOMEWHERE. And, if they are, you have to abide by the state they are licensed in. This is what I understand regarding PA law.

Plus let us not forget that they don't always deduct the amount agreed upon, some people get the fee taken out for over a year where they are not adding a paydown after the 4th rollover to bring down the balance!

hi everyone i am kind of counfused - i thought geneva roth was not licensed anywhere - its' julespooh from PA - i sent them my letter about not paying anymore to them as they are operating illegally - if they do in fact have a license in utah i want to pay what i owe - however my loan is for 300 and i have paid in fees and pd in full past loans $1150.00 do i still owe the 300 on top of that as they are licensed?
i followed the thread to this page and read about the lic in utah - i emailed them about a license registration and got no response - just that it's been sent to the correct department - what to do ? if they really do have a license i guess i will do a moneygram payment? but there is no way i am paying them if they are no licensed.
