I have been in contact by an Attny. office in Massachusetts, Harris & Dial PC.out of Andover Ma.(they have a not too good report of Rip Off Report)
They called and I sent out a verification letter to them. I went on the Massachusett licenced debt collector list and lo and behold they aren't even licenced in the state they practioce in. I just got a call from my human resorce director she got a letter from them with my SS# on it wanting verification of my employment. She called me and gave it to me. The letter to her was written the same day as I got a letter from them. Is this something that is legal? Should I be in contact with an Attorney of my own? My human resorce director said something about my SS# on it wasn't legal? Thanks for any input.

Welcome to the forums. What are they trying to collect and for how much. I am assuming that you sent them a validation letter. Look at the models of these types of letters found on this site. If you go to the Do It Yourself link on the side of this thread and click you will find all kinds of letters. Make sure they give you all the info that is required, not just how much they want. They are subject to the Fair Debt Collections Act and must provide you with all the details.

If they are an attorney they most likely do NOT have to be licenced as a debt collector, but do have to be registered with the MA State Bar. If they are, then they have legal authorization to collect in MA. They are still bound by the fdcpa. If you do not live in MA, then you need to find out your state's requirement for licensing or registration of attorneys. Do they specifically have to be licensed or registered in your state? or does your state have some sort of reciprocal agreement with MA? Either way it soundslike thye may be gearing up to attempt some sort of legal actions. If so, take any legal documents you receive very seriously. If you doubt their validity, contact the court in question to verify. Some lawyer have been know to serve a person, then send false official looking documents saying the court date was postponed to trick the consumer into not showing up in court so they would get an automatic judgement in default. Make sure you (or your attorney if you can afford one) shows at any and all court dates to protect yourself from unreasonable judgements in default. By showing up in court you have a chance at the court ordering them to work out some kind of acceptable arrangement with you.

Hi, welcome to the forums!

I am a human resources director..Can you be a little more specific about the letter your HR director recieved? The ssn in itself should not be illegal..I'm wondering about the specifics of that letter. Obviously your HR person smelled somthing funny with it. Feel free to pm me.

I have dealt with this company. I have to tell the truth they did not harass me or send fake paper to confuse me. They just wanted to settle a balance I had with another company. I wasn't happy to hear from them but I settle and we moved on. I know a lot of people don't like when bill collecter call, but it happens and if you owe money or have filed paper thru court there is nothing to be mad about. I feel this company was fair. I still wish they never called but atleast one less worry on my head and one less bill too
