I have 2 basic questions that I can not seem to find the answer to. I have been to the state attorney general's office website and googled and read so much tonight.
PDL was taken over the internet. First question. Doe the PDL laws for both the state where I reside in and the state where the PDL originated apply?
And please oh please, can someone respond to this with the PDL Laws for Nevada.

They laws that they have to follow depend on your state laws pertaining to Consumer Finance. For example, if you live in PA but the PDL is in Nevada, PA laws say the PDL store can do business in your state as long as they follow the laws of their state. On the contrary, a state like Illinos specifically says any lender doing business in Illinois needs to be licensed in and follow the laws of the State of Illinois. In this case, Illinois law would supercede Nevada law. You should look up your state laws, or call and ask you state department of financial institutions, if an out-of-state lender is bound by your state's laws.

Problem with DebtCruncher's analysis is this . . . What authority does your state's AG have to enforce your state's laws against a lender in another state? (Ask KYSide how her hero, Darrell MacGraw, is doing with his suit against internet lenders. Only one of them even bothered to answer the lawsuit.) Or better yet, ask the Kansas Bank Commissioner about the multi-million dollar fine it tried to impose on Quik Payday of Utah. From what I've read, Kansas is getting its ass kicked in federal court since the lender sued it over the fine.
Where it does make a difference, though, is if (a) the lender tries to collect in court and you plead your state's laws as a defense or (b) if enough people come together for a private class action suit in your state. But state AG's? They might send a letter and the lender will choose to back off. They might even file a lawsuit on Election Day to grab a few headlines (like MacGraw did in West Virginia). But they will never make a serious dent in the industry. We need Congress to pass a federal payday lending law or the U.S. Attorneys to start prosecuting these guys under the RICO act, just like they do the mafia. Until then . . . this "industry" isn't going anywhere.

I live in florida, and i cant get a straight answer,can pdl not licened in the state still give loans, and if they can who state klaws do the have to follow,?

I've talked to the FL dept of financials too and got a person that didn't know anything . . . . I've looked at the laws and spent hours reading them. They do have to be licensed in FL unless they are backed by a bank. Period. The people that answer the phones there aren't very helpful sometimes . . . .
