Creditor:

I recently obtained a copy of my credit report and noticed that your company has reported me as having the above listed account as: (delinquent, sent to collections, etc.). I wish to bring this account to a resolution that will be fair and beneficial for both of us. Therefore, I propose to pay you X monthly payments of $, or forward a check to you in the amount of $ as payment in full, provided that you are willing to send me a letter stating you will report this to any and all credit reporting agencies as: 'PAID AS AGREED' or notify me in writing that you agree to delete this item from any and all credit reporting agencies.

I WILL NOT agree to accept a 'PAID P & L' or 'CHARGE OFF' for an additional amount of time on my credit report. It is my position that I have suffered enough as a result of this problem.

Upon receipt of your letter I will send you a cashier's check or money order in the amount of $.

Sincerely,

Signature Date signed

Like I said before, do not send them anything. I do not trust this company. I think first things you need to send them a debt validation letter. This will require them to show that the debt is valid and if they cannot do so they have to remove it from your credit report. You may need to close your bank account because didn't you say earlier they already debited your checking account?

Sounds like they're already breaking the law as well. Within 5 days of contacting you they must send you a written statement showing who they are, the amount allegedly owed, and the name of the original creditor. They also must have their address and phone number there so that you can contact them.

Guest, who is the collection agency, and what are they stating the debt is for?

Hi bgo. I was in a similar situation recently. Is it a federal student loan? If so, you can probably work out arrangements. They agreed to put me on a 6 month forebearance. They have been excellent to work with and they don't report to the credit bureau as long as you work out arrangements with them. Just call them and let them know your current situation. Chances are they may even adjust your monthly payment to a lower amount for a period of time.

If you have your statement then it should state who you pay the loan to. I would check it and read everything on it to see if there is any indication. Did you apply for the loan through a source at school or did you actually apply to a bank to get the loan? I know that some banks do offer loans intended to cover school expenses, but I'm not sure how different their rules are.

So I guess they are the ones who back the loan. Have you contacted your school? I don't know if they would have any suggestions but it's worth a try. Also, do you have multiple loans? I know that I had to consolidate all of mine into one because I had several small loans that I had gotten for each semester and it ended up being alot cheaper to consolidate. You might even be able to get a lower interest rate.

Thank you for the help I'm out but I will look at my credit report also is it true that after seven years something on your credit has to be removed

bgo-Without going into too much detail about my industry, I can definitely help with this one....

Do you mean Wachovia is showing as the loan carrier (aka funder) or they show an inquiry?

You asked about something being removed from your creidt after 7 years, Are you asking if these student loans will be removed after 7 years?
