Epayday loan
PO Box 571992
Murray, UT 84157
Regarding social security number: SSN# deleted for your safety - Mike
To Whom It May Concern:
This letter is regarding the loan I took out on April 2006 and defaulted on and now been assigned to Central Portfolio control.
My current balance to your company as per central portfolio control is 380 dollars with the original balance being 400. After doing some research I found that I have paid a total of 600 dollars just fees and principle paydown and my loan was only 300 dollars
After further research I recently discovered that epaydayloan or any dba is not licensed in the state of Minnesota to issue payday loans making the loan null and void. Epayday loan has violated Minnesota law by overcharging on interest and issuing loans without a license.. Minnesota law states that a person only pays 15 dollars for every 100 dollars borrowed with no rollovers.
If however you are able to prove me wrong and show written proof of your license to operate in this state, and that you have followed all applicable lending laws then I will be agreeable to pay the balance with interest to the collection agency.
In everyone’s best interest im demanding my account get pulled from central portfolio control and marked paid in full and the 300 dollars that I overpaid your company get refunded by papercheck to the address on top of this letter. I have paid more that I was borrowed.
Rest assured epayday loan and central portfolio control will not see a single additional cent from me no matter what measures you attempt to employ. I am informed and well prepared to do whatever it takes to make sure that I am protected, and that others like me do not fall victim to similar illegal lending practices.
If your company fails to respond within 14 days of this letter I will file a complaint with the Minnesota attorney generals office. Please respond
Thank You

I think that sounds good...we just need a mod to get your SSN and address off there for your protection. The only thing I would change, I think, is that I would say, "I have reported this matter to the Minnesota attorney general's office..." and really do it. They may take you saying if they don't reply you will report them as a threat. Good work perry! Let us know how it turns out. I can tell you put a lot of thought and effort into that.

Do they really need 14 days time before you inform the attorney general about their illegal business? If I were in your place, I would have sent a copy to the AG along with this mail to epayday. This should have made them more cautious in settling your account.
