Has anyone ever dealt with these people? Can they send a validation by regular mail before you ask for it and claim you got it when you didn't. This was out of left field about a half an hour ago.

Yeah to me that sounds like they are just looking to get what money they can out of you and hoping you are dumb enough to give it to them without the debt being validated.

Right, but they are saying they already mailed it out. Do they have to mail it again, since they are claiming they already did? Which I'm sure they didn't, but it's not something you can easily prove . . .

They are using the 5 day mailbox rule to try and skip the validation process. Tell them to validate or pay your debt out of statutory damages for failure to send validation notice as required by law.

How do they know it was "delivered by the post office"? That's what certified RR is for. If she's "not very familiar with the fdcpa", she'll soon be familiar with a law suit.

well, a lot of the confusion seems to come from the fact that most of these debt collectors do not even know what validation means. I actually have had collectors(more than one) tell me that they just validated the debt over the phone by confirming my identity. That lady could be talking about anything from a standard collection letter to who knows what else. They dont care about validation, they care about getting the money. Heres an interestng idea--take a look sometime into the bigger collection agencies. Check out the incentives that some of them offer. I am currently getting a ton of phone calls from one CA that gives away brand new cars each year to the collectors that take in the most $$$ or resolve the most accounts....where do you think their motivation is?

Sky,you are correct. It is a money driven business.I was conversing with a collector who posts on another consumer board. He is one of the 1% or less who follow fdcpa. He states that of the thousands of accounts, there is only about 2% of consumers who actually request validation.
ca validation
Thanks everyone! I wrote the validation letter asking for all the usual stuff as is listed in the cajunbulldog version. I especially like the someone vs someone part about past payments received. In my letter I clearly stated that the call I received was the "first communication either by phone, by mail or any other means" that I have received regarding this. I also stated that the caller, Andrea, refused to give me a physical address to mail the letter, only a PO Box. Just in case they say a registered letter can't be sent to a PO box. I am still searching for a physical addres. I am going to try the Seattle BBB. That is where they are.

I found their address at the bbb in Washington. They have an unsatisfactory record for not settling complaint and/or not responding to complaints. Another company with a give a ---- factor of zero. At least now I can get a signature. This one is worth the blue priority envelope,

I recieved a phone call today From Marcy at the national service bureau. and she was very much so rude in every way. I ask her for her full name and she culdn't give it to me. i know the calls are recorded and i ask how do you spell your first name because everyone spells there name differnt she gave me a hard time. and she would not give me her last name then she lied and said she did. when my NCO got the phone he ask for the information and gave it to her. Thought suppose to be for the people not against the people but Marcy Nora is not customer friendly and rude and puts words in peoples mouths that was not stated. i feel that is not right.
work at a cash lending company
the fact that she would threaten you, by saying she is going to call your work to get your position and salary is utter BS. You company would not even give that to anyone calling on the phone
I am a Victim
I have received harassing phone calls from this company. A man calls me at work. Will not give me his name. All he tells the person who answer the phone I should know whose calling because I owe them money and I should be more responsible in paying my bills. When I speak to this man I ask what the debt is he tells me I should know who I owe money to and demands a credit card. When I tell him I will not provide a credit card and to send me what I owe and to who in writing he laughes and said "I don't get paid to sit on my a** to lick envelopes" We don't answer his call because we have caller id in the office. I files complaints with BBB, FTC and today the attorney general. Can anyone let me know who else I can complain to. This company are hurting people and I know what they are doing is completely against the law.
yes there is more
file a complaint with your state AG(attorney general).other than that you have it covered.
