She wants as much information as she can get so she can scare you into paying. No court in the country moves that fast. That's the first clue she was lying. If they sue, they have to serve you. Usually by mail if its small claims. Then you have a certain amount of time set by law to file a response (in most states about 30 days). Only after that does a court set a court date.
I'd tell her this, "Let's go double or nothing. If you can get me in court today, I'll pay twice what I owe. If you can't, you send me a PIF letter."
Safest bet you'll ever make . . .

What company is this? They are making illegal threats. You need to file a complaint with your Attorney General's office. Please don't be intimidated by her baseless threats. You are NOT going to court and you are NOT going to be arrested. That is a famous lie they tell people to extort money from them.

ACE (America's Cash Express) did the same thing to me! They called me at work, saying they needed to know my "demographic" (I think she meant where in the building I sit, so they could try to come serve me papers which I found out later is illegal anyhow) and a bunch of legal sounding jargon that I didn't understand. She said I had to pay the debt in full by 1pm or else show up in court blah blah blah. I ended up overdrawing my checking account to pay them, and taking out another loan with them that same night, to pay back the bank... and there I was, caught in their evil web again!!! I've vowed to never again take out a pdl, no matter what the scenario.

First off, most of these IPDL are not operating legally in most or any states so the chances of them taking you to court..pretty slim since they would never hold up under scrutiny of the court! Second of all, you have probably paid them what you legally owe them in so called fees. I would contact your attorney general and file a complaint on this person.

The heck with the loan, illegal threats are active causes of action for a civil suit.If it is not a collector, then file under state version of unfair practices. Let them settle for a little travel kitty and pif letter.

Actually if it is not recorded, you can type it up paraphrasing from memory. This is how attornies go after collectors when consumer is in a two party state.Just keep a simple log of date/time call occured, name they gave, threats,& etc. Your word against theirs. Not as good as a recording but still proveable.
