Yes, I'm back after one year. Back in black!
As we know, all these online PDLs are illegal. Most of them gave up on me after fighting them with letters saying the loan was illegal. By the same token, I got rid of the ones who reported it to credit reporting agencies. All three of them had been helpful when I explained to them that the loan was illegal and/or there was no written contract/agreement with my real signature on it to prove the loan.
However, after one year, two of them (United Cash & One Click Cash) have come back to haunt me by using "Federal Mangement Services" as a collector (Tulsa, OK). FMS reported me to Experian. I entered a dispute with Experian online telling them in short that there was no proof of the loan and the loan cannot be validated. Experan (unlike last year), after 30 days, said they "verified" the debts! So I re-entered another dispute stressing the fact that there is no proof of the loan and I will take legal action against Experian if they don't remove it.
Am I going in the right path? Are there other alternatives?
BTW, Equifax themselves put an identity theft check on my file and also blocked all promotional inquiries after so many disputes I entered last year. These online PDLs are such shady companies that even Equifax got concerned!!!

If they verify second time.Send a written letter stating you want the methods & procedures used to verify as is your right under Frca. You could also dispute it with the collector and if they verify, sue them on Fcra. The collector will be easier to sue than a credit bureau.

I am going to follow cajunbulldog's advice and send a validation request to the collector first asking for the loan agreement with my signature on it. If they fail to do so (which is the case), I'll sue the collector. After I hear from the collector, I'll also write a letter to Experian.
The question is: what if the collector never replies (which is most probably the case coz there is no written proof)? How much time should I give the collector before I take legal action?

Try a combo dispute to remove.Send a certified mail return receipt dv letter to collector.Once you get card back saying they have it,send dispute letter certified return receipt to Experian. If the collector verifies the account without validating, they are in violation.

The CRA's will ask for proof of identification from a consumer when they submit written disputes. If this was an online dispute, they may not have been able to certify your ID from the info you submitted. Ive sent a copy of my DL with the number blacked out as well as a copy of my SS card with all but the last 4 digits blacked out.
