Hi,

I asked this same question awhile back, now i am useing a new eamil address. I still need more advise on this question:

Is it illegal to close a checking account when I have 10 post dated checks out on it that are written to a store front check n go in Aurora IL? I live in Kane County Il. which is 5 miles from this nightmare check n go. What I asked for was a repaymeent plan, and what they gave me was an installment plan (this is how they get around the law, they just reword everyting). Now I have to stop payment on the checks when they come due every two weeks, which is costing me a fourtune. They still have the other 6 post dated checks. I did open a new checking account, but i did not close the old one, just have .25 in there.

Should I close this old account?

Good question! In this case, I think there are pros and cons to closing it. On one hand, the PDL did agree to a payment plan with you in that they agreed to do it in 10 payments, but the only bad thing is that they are doing it with checks.
Would you be able to buy money orders and do it like that? I can understand wanting to close the account, since anyone else could get into it, but getting that PDL paid off, since it's a storefront, should be top priority.
As I'm sure you know, a storefront PDL is usually licensed in your state and is following laws there, so they could take you to court.
