Summons update

I talked to the pre-legal department with my debt settlement company and they told me that they really can't do anything to try to help me until we have been served papers. She said that right now, all we do is basically sit.
She told me that they may NEVER serve me a summons. She said that they put our names in paper to be mean and ugly and hope this scares you into running to them with money in your hand. I told her that I pulled up my fathers bankruptcy records and told her that he had his civil announcements on him from credit card companies as well (5 years after his bankruptcy) and they were all dropped. She told me that it is very likely that they did pull our asset information and decided that we are not worth the hassle to proceed with by further actions.
Worst comes to worse scenerio, she said they will proceed and do all they can to work out something with them to keep from going to court and if that don't work, she said that we would go to court and tell the judge our situation. More than likely we will make payment arrangements through the court, but she said she has not seen this happen but twice and he people had assets...(we don't).
