I'm from Ohio, and I've had my storefront pdls with T&C's debt management program for 2 months now. Even though T&C has contacted my pdls and have sent proposals and payments to them, they are still calling me at home and at work daily. I've even sent letters of cease and desist to the pdls asking them not to call me at work, but they still call me at work. One of my pdls has even started threatening to send my file to the county prosecutor's office! Does that mean they are going to have me arrested?! T&C has told me that I cannot be arrested for default on pdls, but I must admit that I'm worried about what could happen to me. T&C said the worst that could happen is that the pdls take me to civil court. Anyone here who's from Ohio ever had this kind of problem even though you had your pdls in a debt management program and payments are being sent to the pdls? Any insight and/or advice would be greatly appreciated, thanks!

Misty

Lenders will stop calling after they receive a couple of payments from your consolidation company. Check with your dmp if they have done any payments to your creditors. If so, you can let the creditors know about the payments being done through your DMP and to contact them since they are better aware of your account status.

Send the pdl companies a certified letter saying you cannot recieve calls at work you have a working home phone number what time to call you at home. let them know you will sue them (U CAN) if them continue to call you. Under the fair debt collection act if you have a working home phone the not to call you at work. make sure you put it in writing and send ti certified. certified is your proof they recieved it.

I agree with samesituation on how you should handle it. I wanted to note that even though you are using a consolidation company, PDL's or other creditors are under no obligation to accept proposals or work with your negotiators. I suspect that is why many of the consolidation firms out there do not touch PDL's. I don't think that many PDL's readily accept consolidation proposals due to the small payments they are set to receive. They probably feel like their collections team will be more effective in recovering the debt.
