I would contact your state's attorney generals office and report this. That is illegal they have until the end of January to get those out to employees, present or ex. That is a big no no. Also, I would contact the IRS and report them also, this means they have to be doing some tax evasion or something like that.

You should definitely call the IRS and ask them what to do. If you don't, they may throw you in the mix too for not reporting that income.
I know they assess fines for late filings. I had about 4 1099s I needed to send out this year. I thought the deadline to get it to IRS was 3/15 but really it was 2/28. They fined me $15 per form under 30 days late, and the fines double after 30 days, and again I think after 60.

Definately, definately call the IRS on this one. If they have to send a request for the W-2's, you are exactly right--the business will be fined per each request. Now for the bad news. This doesn't relieve the taxpayer from the obligation to file their return or a request for an extension, on time.
If you still don't have the form, download a sample W2 form from the IRS website, and mark it estimated W2, and send it in. I would also include a copy of the form you filled out asking the IRS to go after the W2.
