Major cry of help about pdl

My husband and I had 3 large pdls out. Each 2 were for $1000 and one for $1300. We were doing ok with them for a bit until my husband got sick and missed a few days of work. The company Payday Loan Store that we had the $1300 loan with deposited our check after I told them I would be coming in for the renewal as always. Apparently they had a new employee and they claim she pushed submit for the ACH transaction instead of renew. Anyway, they submitted the check for $1650 and of course it bounced. Then they spent 4 days bugging us about the fact that it bounced and sent us a letter stating that if we pick up the rollover where it was they would work with us, so we agreed to do that. Then on Friday the 18th when our tax return finally got deposited and my hubby got his sick pay they walked into another branch of our bank 4 towns away and CASHED the check!!!! We needed that money badly to get caught up with other stuff and they went against what they said we could do!! is this legal? Breach of contract or something? Now becasue of this all the people I promised to pay money to(I knew my return was coming in then) are totelly POed at us and threatening us with all sorts of bad stuff, right down to eviction from our landlord for late rent. We needed that money and they took it all when we had an agreement as to otherwise. What can I do? Now because of them we are contemplating taking out another one just to keep our apartment, not to mention the first time they deposited they caused our Light payment check to bounce, along with a couple others..... We need advice really badly and can't even afford a lawyer consult...... HELP US PLEASE WE DON'T KNOW WHAT TO DO!


I read what your site had to say, but we already knew all that, we never make just the minimum payment on our pdls. We always pay down on the principal. I want to know if I have any legal footing to get back at the Payday Loan Store for the breach of contract. I've gone through all of our loan docs with a fine tooth comb and it doewn't state that they can break our agreements at anytime they wish even the payment arangement we made with them after they deposited our check the first time doesn't state they can break the contract at will. I guess we're gonna have to get a lawyer on this because the more I research it the more it all seems to come down to breech of contract and cause of financial hardship due to breech of contract.

I would definately contact the naca.net and see what they can do for you. There are so many lawsuits out there against payday companies it is unreal. Thats why I always advise to contact the Attorney General or the Banking Commision in your state. They are the lawmakers that can actually get a change. Best Wishes to You. Kyside38
