car repoed and the company wanting to sue us

Me and my husband was recently discharged from bankruptcy,The car we were driving broke down there was no fixing it,it was dead. So the only thing we could do was to go purchase a nother car,with 5 children, We just did not have cash on hand to go purchase a car with out a loan. So we get a suv we pay $13,500. Ok now everything is hunkie dorie,then 6 to 7 months of having the suv the transmission goes out,oh yhea when we purchased the suv it had no warrenty,and now they want $3,000. to fix it.We did not have the cash and of course the payments are still due,so we let the suv go back.Now they the company "Capital One Auto Finace" are wanting to sue us for $12,500.They sold it for $1,700.I do not work just my husband,I know they can garnish his check and if they do we will be up the creek with no paddle,I am afraid will lose even our home,I mean with garnishment,morgarge,food,utilites,gas,and just all the things that come with having a large family.WHAT CAN I DO I NEED SOME HELP PLEASE!!!!

jj is right. You need to call Capital One and work out a payment arrangement. If they have already filed a lawsuit, they will try to get the money through court. If you don't stand with a strong defense in front of the judge, the situation might shape up against you. You need to call the company and get this fixed outside the court. When is the court date set?
