Cash Transfer Center not subject to US laws??????

I've defaulted on my loan to them and I'm trying to work out a payment plan (very unresponsive to that!) and in looking at the contract I signed it says:

Quote:
"Because this Agreement is not made until we have accepted it at our office in the Republic of Malta, the laws of the Republic of Malta shall apply to this Agreement."
and

Quote:
"The Republic of Malta is the place of the making of this Agreement. This Agreement will be made in Malta by you signing and sending this form to us and our acceptance and signing of this form and this Agreement shall be governed by and construed and interpreted in accordance with Maltese law except that the International Arbitration Rules of the ICDR shall apply to the Agreement to Arbitrate Disputes.The Malta courts shall have exclusive jurisdiction to hear challenges to the Agreement to Arbitrate Disputes contained herein, and to all disputes or claims arising under this Agreement that such Court, or the Arbitrator, deem to be incapable of arbitration."

Does that mean that the illegal interest rates are allowed then? And that my Attorney General has no jurisdiction?


As stated, they must follow the laws in your state. They are just basically blowing smoke right now because they know they are in the wrong. A lot of us here have dealt with them so feel free to ask any questions. I would stick to your guns and keep telling them they MUST follow the laws in your state. I would also send them a certified letter via return receipt. I have a US address if you want it.

I heard they were kicked out of Malta. They are quick to offer settlements if you resist them, but make sure you revoke that wage assignment as it will be their first move. Tell your employer that you revoked it and not to honor it. They will also call your refs. They settled with me for 40 percent when I resisted them.

I wrote them a letter revoking any wage assignment and told them that I found out they are not licensed in Kansas where I live and that I would be contacting the attorney general and state banking commissioner. I called my payroll department and they said that wage assignments are not legal in Kansas that they would have to do a garnishment. After I faxed that letter I have not heard from them again. I am paying them through Town and Country Acceptance, so they are slowly getting their money. I don't know if it would work for anyone else, but I have had results with faxing them a hate letter. Just be sure you know your stuff to back it up with. I faxed it to 888-395-0192 attn: Ms. Kimberly DeThomas, President. It should be to their payment services location in BC.

I too have been sucked into this vicious cycle. They have contact my job and although I am willing to pay the debt that I indeed owe, they want the lump sum right now. What is the process now that they have contacted my job, oh yeah she did reference that they were going to send my job the papers to garnish. DOes anyone have the entire contract that is signed when loaning with these B@#*@&$*(@(? Any and all help is appreciated.

No where in their contract does it state anything about volunary wage assignment-I revoked it anyway however, and made their collection person "Alan Denver" angry...he left me such a nice voicemail!

Please, please, please file that complaint with the AG!! That is the only way these people are going to be stopped. This is a horrible company. I just received a PIF letter last week thanks to the AG of the state of Ohio. It took at least 2 months to get it but I got it!!!! The only way they are going to be stopped is if everyone complains to everyone that they can!!!

Jcornell, try googling Wisconsin Attorney General, that should provide you with a link to their website and instructions on how to file a complaint. Some AGs' websites allow consumers to file complaints online, others will have you download the papers and mail them into their offices. Good Luck. :D

Thanks everyone, you have all been helpful in many of the forums. I have some questions for those of you who have been dealing with this for some time noe. I just defaulted on all of my loans in the past 10 days. How long have you been dealing with yours? I understand that the calls and e-mails will be constant for awhile. My plan is to pay each of them at least $30 every month. In your experience have they backed off a bit after you started paying them back? Just looking for a little encouragement. Thanks :)

It can be rough in the beginning with the threatening phone calls. But it does get better with time. I fought my internet pdls and did not back down, also filed complaints with my Attorney General's Office which helped. I was able to get my internet pdl's marked paid in full, because I really did pay over the principal and legal interest rate for my state. And the fact that none of them were licensed in my state, which is the case for most others, if not all. I would say that I dealt with my internet pdls for about 1 1/2 to 2 weeks. With the exception of GFSIL, they recently backed off and went away.
