:( I am really sorry for getting mixed up with the payday loans but I have learn my lesson and never again but how do I get them to stopping taking money out of the badfnk and running charges on the account to make NSF charges that way I can not pay them due to this. I live in texas and do not know the laws concerning the loans as in closing my account and stop payment on the account. what can they do to me like take my wages or income tax. If someone knows the answer to this it would really help. Donna e-mail deleted for your protection - Suebee

Hi Donna -

welcome - you've come to the right place for help!

First, put your mind at ease about your income tax - they won't touch that.

What we need to do is determine a couple of things, and then we'll be able to offer you some concrete advice to help you work your way out of the endless cycle of payday lending. Most of us here have been there at one time or another, and for a lot of us, that's the reason we came here ourselves! We learned from those who came before us, and stayed to help others afterwards with our newfound knowledge. We hope you'll do the same! :D

Here is the law for Texas regarding payday loans(just select your state),

http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html

Now that we know you live in Texas, and the law for Texas as shown above, we need a little info from you so we can offer you some advice.

What company (or companies) do you have loans with?

Are these internet or storefront loans?

How much were the loans for originally?

How much have you paid on each loan?

Armed with that info, one of us will respond with advice on your next steps.

Take a breath and relax - your situation is temporary - and you'll be through it soon!

Hello Donna ~ Do not feel alone in your quest to get out of PDL hell. Several of us have been there and have worked our way out of it or are in the process of working our way out of it. Provide the information that Suebee asked. The more information you can provide as far as your pdls the better the great people of this forum can help out. Hang in there!!!

I had a payday loan company's collector call me threatning to press charges against me. I truly don't even remember borrowing this loan and ask could they forward the documentation to me. They said I needed an attorney, and that they could forward the information to my attorney. I spoke with an attorney, and he said it was a criminal act for them to contact me with such charges. I don't know what to do? Any any advice here would be greatly appreciated.

I took a cash loan from CASH NET USA in 2097 and have been unable to pay for it. The interest and late charges are eating me up. I paid a couple of payment but have been unable to continue payments. I was forced into Chapter 13 bankruptcy in 2007 Bu this loan did not get included. They are no representing themselves as some law office in New York City and are threating me with a misdemeaner charge. Can they legally do this I live in Texas. What is my rights under the law. I am living on my social security and can not pay for this loan.
