If they take you to court you have a rock solid defense, they broke state law and you have already overpaid. The thing is, they already know that. Internet pdl's are ridiculous with their phony threats. Don't believe anything they say.

What payday loan company is this? I might be able to help you out more if I had the name of them. I'm familiar with a lot of them. I doubt they will take you to court either. This is a common scare tactic used by these places. Keep all correspondence from them as it might come into play in the future. Also, file a complaint with your State's Attorney General's Office and Division/Department of Financial Institutions regarding this matter. They usually calm down after a complaint is filed.

The company is payday online. I contacted the AG for Delaware who said that it was the Department of Banking I should deal with. I contacted them but haven't received any feedback or reply for help. I am going to put another call into them on Monday. I just don't want to sit on my heels and then get waylaid by a law suit.
