Do collection agencies look at credit scores before they sue debtors? Do they make a decision to sue according to the credit score?


collection agencies don't have the rights to sue debtors, unless they have purchased the account from the original creditor. In most cases, they are hired by the original companies for collections. If they are unable to collect the debt from the consumer, they will return the file back to the original company. They will decide whether it's worth suing the consumer. There are many factors considered by the creditor before suing anyone. Most of the time, it is decided after considering the total amount of the debt including the court costs and fees.

1) Some collection agencies do have attorneys on their staff. They may work the account a little bit and make some phone calls to see if they can shake the debtor up a little. If that doesn't work, then the CA might recommend to the creditor that it is best to file a lawsuit. If the creditor says okay, then the CA files a lawsuit on behalf of the creditor-- naming creditor as Plaintiff and CA as attorney for the Plaintiff.

2) Yes, they will look at a persons credit report before suing. Score really does not matter, they will be looking at the actual tradelines. They do this to determine how successful a lawsuit might actually be -- ie if they pull someone's credit and see that their car has been repo'd, the house is being forclosed on, and 3 other companies just got judgments, chances are the person is about to go bankrupt. In that case, they might decide not to waste their money going to court.

Below is a link to a fantastic article about the collection industry written by a person who spent years in the industry. It is shocking to read about the way they operate. In the section in the beginning under "contact". He says "collection agencies don"t sue people." Read for yourself. It is a don't miss article and a real eye opener. I have put up this link before and was disappointed by how few went to it. It is really worth your time.

Alot of collection agencies these days either have in house lawfirms attached or have a regular partner, there is some type of connection between the two, they will sue if they have purchased the debt.

They will look at your credit reporting to track your behind down, I know that. Once there is activity from your end, they got ya!

What is sad is that they purchase inflated debt for pennies on the dollar and then want to charge you even more instead of offering a descent settlement amount. Both parties would win. If they say they have purchased the debt, make them validate. Otherwise, you end up paying someone who does have a legal right to collect in the first place. Hope this helps.

HUSBAND BLIND AND MENTALLY ILL TO COURT BECAUSE
I DONT THINK IS RIGHT TO HARASSED HIM HERE FOR SOME BOGUS ACCOUNT HERE.
