Can I be taken to court over a payday loan in Michigan?


The answer, unfortunately, is yes AND no.

If you are dealing with a storefront lender, like Advance America, Instant Cash Advance, etc. - YES - they can and will take you to court. However, it is not a criminal matter. It's a civil matter - but they can still take you to court, and if you do not show up or refuse to make payment arrangements, the judge will give them a judgement against you, which means they can then proceed to garnish your paycheck.

If you are dealing with internet-based lenders, that's another story.

Please let us know what type of lenders you are dealing with.

Call them right away - tonight if possible, or first thing tomorrow morning, if they are already closed today.

You definitely need to communicate with them, or they will attempt to take you to court. It's possible you may still be able to work out a payment arrangement with them. But time is of the essence here - I can't stress that enough.

If the companies are storefronts located in Michigan, and you applied at their website, you CAN be taken to court, because as a storefront in this state, they have to be licensed, which means they can take you to court.

I am almost certain that CheckNGo is licensed in Michigan, because they have storefronts here.

Michiganpaydayadvance.com, I'm not sure about - I couldn't get the licensee database to come up this morning to check on them. But if they have a storefront location in Michigan, they definitely have to be licensed.

Your best bet is to make payment arrangements with these companies, and quickly. If you don't, they can and will take you to court.
