You need to close your current account and open a new one at a new bank if at all possible. This is the first step in taking back control of your finances. Be prepared for the harassing and very THREATENING phone calls from these internet payday loan companies. Just know this, they are going to threaten to press criminal charges against you and have you arrested. No matter how real they make these threats sound. IT IS ILLEGAL FOR THEM TO THREATEN YOU WITH THIS, because you will NOT be charged with a crime nor will you be arrested.

bflow30,
Welcome to the forums :) First of all take a deep breath and try to relax for a minute. We can help you on your journey of getting out of the pdl trap. May I ask what state you are in? This will help us determine the lending laws in your state. Are these all internet lenders or are some storefront? Steelers, gave some great advice as well. You will want to close your checking account and open a new one. It's one of the first positive steps in getting out of this trap. Don't worry, we are here to help!
Before you close your checking account, check with your bank on
Before you close your checking account, check with your bank on their policy of debits coming through on closed accounts. Some banks allow debits to come through even after the account is closed. Then the pdl's could go through and you could end up owing a perfectly legal bank a lot of money. If they say the do allow this, see if they can put a hard hold on it first to keep any debits from going through...then have them close the account. You will feel so much better once the account is closed and they can't touch your money!

I am fortunate in the bank account issue as I had already started a new savings account and they will allow me a checking to link to it. Of course, the savings is empty, since the PDL's have all my money each month, but, it will get better. How can I find out if my PDL's are licensed in my state?
I hope that is a new checking account and a new savings account.
I hope that is a new checking account and a new savings account. Because these crooks have been know to get into the savings with the old checking account left opened and linked to the savings. I know, it happened to me. :(
Here is the link to your state's laws and it also provides a link to your state's lincensee lookup data base. Just click on your state.

Are the new accounts at a different bank? If not, I would highly recommend going to a new bank all together. Sometimes these places do searches by social security number and the banks allow them access to the new accounts and you find yourself back in the same situation.

That link should also provide another link to your state's licensee data base look up. It would be at the bottom of the page which state's your state's pdl laws.
And I am glad to hear that these new accounts are at a new bank! :D

I had 3 and i was freaking out. I did not know what to do and I have just found this place, but I did what steeler suggested, I closed my account, so they could not debit me. I opened another bank account, and the creditors haven't called me because I got a cable network phone, unlisted too. they cannot do anything, in fact, you can call credit counsling i think and ask for extensions. the nice lady at one of the payday loan places, that is working with me, told me to call family lift 813-989-1900 and tell them i need help/extensions. that's tampa, but you must have something near you like that. good luck, i know the feeling very well. lisa
Knowledge
One of the things that has helped me (I have 10!!)is to sit down and organize everything. I took a pad of paper and listed each loan. Matched it to my state laws to figure what I should pay and then went through bank statements to see what I did pay. You can find so much info on this site: there are telephone/fax numbers and in some cases address too.

Sass,
That's a good point about the banking info. You want to make sure your other debits will go through. It's so much easier than trying to block the ACH withdrawals on these loans. That gets expensive and some use different names to withdraw.
Totally true!
Oh god! So true! Everyone listen to the advice regarding your bank account! My account was closed, but the pd debits went through & that caused a huge mess. A whole other story though! Make sure you have a debit block on your account if you can not close it. I couldn't put a block on "specific companies" because they use so many different names to get your money. I had to put a total hard debit block on the account until we finally just got it straightened out. Do not open another account at the same bank! Run to another bank! As already advised, they will get your information if you're at the same bank! Learned this from experience!
Has anyone closed their account and had overdraft fees assessed?
Has anyone closed their account and had overdraft fees assessed? Or was it closed and not allowed to process? I know it varies per bank and I am going to check with my bank on Monday but I was curious.
That hasn't personally happened to me but it happened to a frien
That hasn't personally happened to me but it happened to a friend of mine that posts on here....she closed her bank account but the debits from the pdls went through and then instead of owing the pdls she owed the bank tons of money. It really depends on the bank that you are dealing with so make sure that you check with them. :) My bank account was negative for 30 days due to the pdls and the bank closed it and from then on nothing else went through.
Bank Fees
Oh Lord. Don't get me started. When I closed my bank account, it "re-opened" because pdl debits went through! They had almost $600 of pdl debits, which of course caused a negative balance since I THOUGHT it was closed. Then the bank put totally outrageous charges on there. One for almost $300 and then $6 per day it was negative. Hello! I got the address for my banks corporate office, faxed and mailed a letter regarding the situation, emailed my branch bank office manager telling her I am contacting the corporate office. The corporate office called me. I explained the whole thing, they argued with me for awhile. I stuck to my guns and told them I did NOT agree with their tactics. They said it could take 60 days to "clear this up" and meanwhile charges would still be posted to my account. I was scared to death thinking I would owe the bank approximately $1500 or more before this whole thing was over. I emailed the branch office again telling them of my conversation with the corporate office. Argued with them for awhile. Lo and behold, this morning EVERY PDL DEBIT was credited off of my account and only the bank charges still showed. Amazing how quickly they were able to reverse those charges after they said it would take 60 days, isn't it??? So I called my branch office and told them to pull it up. They were surprised it got credited off so quickly (hmmmm.....) and now they are reversing the bank charges off. According to them, everything should be back to zero by midnight Monday night. You can bet your sweet butt I will be calling the corporate office and emailing the branch again once it's zero and getting them to send me a letter stating the account is zero and it is offically closed and will not be "re-opened". It was a nightmare! But after joining this wonderful forum, I have found that fighting does work. Fight the pdl thieves. Fight the bank if you have to. You have rights. There are laws. So if your bank gives you any grief, you be sure to contact the corporate office and complain. Contact the branch and complain. It's amazing. They'll argue with you; however, look what happened to me. Within a week, the debits were credited back and the fees will be reversed. Ah, the satisfaction of learning to stand up for yourself - all due to this wonderful forum.

If I put a hard freeze on, will I only be able to deposit, or can I use my check card at stores, etc???? ANYONE EXPERIENCE THAT?
Well, the good thing about my work # is that the receptionist answers the phone mostly, so, my boss hardly ever does, I may just claim the identity theft thing and talk to her this week! WHAT A MESS!!!!!

I never had a hard freeze, so I am not sure about the debit card issue. I'm sure somebody who has had a hard freeze will come along and let you know about that issue. Just tell them your identity was stolen, you should be fine. You are going to be out of this mess sooner than you think. :D

I have a loan that says "I understand that the loan agreement between myself and Netcashusa is subject to New Mexico law, that I agree to be bound by such law, and acknowledge that, in the event ot a bona fide dispute between myslef and Netcashusa, that New Mexico law shall exclusively apply to such disputes, regardless of where the proceedings are held". What the h??? Should I worry about this?
$500FAST Cash says the same kind of thing.

No, they all say that, but what you need to do also is file a complaint with New Mexico. I also had a ipdl located in NM and I was told by NM authoritites that the ipdls located in their state had to follow the laws of the consumer's state. But you need to also file a complaint with NM and your state as well. But all of the contracts state that. All of mine did, and when I filed my complaints with my AG's office I was able to settle with them all PIF, with exception of one and they settled for what I legally owed them and they had to follow my state's pdl laws.
If they put a hard hold on your account you will not be able to
If they put a hard hold on your account you will not be able to use it for anything. Unfortunatly, anything that the bank can do to block these pdl's will make it so that you can't use the account. Deposit only is the only thing where you can still put money into the account. Then you can go to the bank, have them remove the hold, withdraw money, and have them put it back on.

They are actually based in the UK!! I got a foreigner calling me from the UK arguing with me about abiding by UK laws. This loan has been overpaid and he insisted I Money Gram him $100. Spare me! Do NOT try to settle with these people. First of all, NV is just an "address" they use. Brian in the UK told me they are based out of the UK and we have to go by UK laws, which of course I argued with. I'm been fighting with them forever now. I overpaid, they want more, they want Money Grams, they call me, blah, blah, blah. They are not even in the US! You can use the above address to send documents. They apparently received them because that's when Brian called me from the UK and argued with me. So here's also the UK telephone number to get to him or another rep. But they'll argue your head off! 1-877-210-9423. Bunch of lying thieving jerks!

Exactly what does this mean?
Thank you for your email. To close an account all outstanding debits, drafts and checks must post. If you have fraudulent activity and do not have any authorized outstanding debits you will want to go into a branch and notify them of the fraudulent activity so that they can freeze the account and have you complete the proper paperwork so that we can retrieve the funds back from the merchants. If you do have outstanding authorized debits you do not want to freeze your account. This will prevent authorized debits from posting and the merchant's to which you do owe funds would charge you for returned checks, late payments, etc. Once all the payments you have authorized have posted then make your request to freeze the account in your local branch and they will begin the closing process at that time. During this process you can open a new account and being using the new account to pay bills.
If you have any other questions, please email us, call us at 1-800-AMSOUTH (1-800-267-6884), or stop by any branch. Thank you for your business.
That means that if you have any legitimate charges, like a check
That means that if you have any legitimate charges, like a check for groceries that hasn't cleared yet, you shouldn't put a freeze on the account because then that check won't clear and you could be charged NSF fees from the store.
If you don't have anything waiting to clear, then you need to go down to your bank and have them put the freeze on the account.

This is what I have planned. I told my husband to go and withdraw expense money for the week. After the ATM goes through, we will FREEZE it. Stop our direct deposit at that bank and move it to the savings account at the other bank, then, link a checking to it since we are already banking there. Then we can close the Frozen one. Since they will clear debits through a closed account, it sounded like a plan?
ANY THOUGHTS?

A dangerous thing to do linking your current savings with a checking account at the same bank. I think you should go to a new bank, you will sleep better knowing these vultures won't have ability to take money from you. Just a thought. These crooks are good for using a person's social security number when at the same bank.

It really is a scary thought that someone out there (many people actually) in many different places has OUR personal information. Even doctor's offices, dentist offices, etc. We give them DOB, SS#, etc to set up an account with them. How are we to know if someone in that office is a crook, just because you do a background search and nothing comes up---doesn't mean that person is CLEAN! Take it from me, I work in HR in Healthcare, SEEN EVERYTHING!!! Sometimes if a person comes up with a clean background it just means so far they've been good enough to not get caught!

don't pay them. i had 10 and i got rid of all but three by simply sending the an email listing all of the interest rate laws they were breaking and i offered to report them to the AG if they didn't go away. add up all of the money you have already paid and compare it to the amount of the loan you got. If you have paid more than what you are legally responsible for paying according to the small loan interest rates in YOUR state, that's all they get. I did the same email to all six of them and one One Click Cash tried to debit anyway. i threatened to turn them in the the secret service for wire fraud and they went away too.
