Anything is worth a shot! I don't know if it would work or not, but if you overpaid on the previous loan, and are now aware of the law in your state, I would quote that law and use that as the basis for a letter requesting to be marked paid in full.
I'm not sure about the debt management program - I'm sure someone else will come along and post an answer to that question, which might blow my advice above right out of the water! But at least it's a start. Hang in there and wait for a few more responses - you'll get the answer you need soon!

**Legally** you should be able to demand that a refund be applied a different account... since they do legally owe you a refund. Here in Illinois I am required to refund anything over $1 back to the customer. The state actually does come in and pull my loan files, they calculate what interest I should have charged versus what I actually did charge the customer, and if they find errors they will write me up and make me give refunds out.
But then again, we know the PDLs don't follow the laws. It's easy to say they owe you a refund by law, but they don't care.
In the least, you should send a calculation of what you paid on the previous account, explaining why they owe you a refund. And then simply state that they should apply that refund as a credit toward your current account. Keep it in writing so that if you need to file complaints later on, it will at least be documented.

Overpayment
I can tell you from experience - but not with the particular pdl you're speaking of - that they look at your loans as two separate loans. I would, of course, send them a letter regarding the first loan that you overpaid and ask them for a refund. Hopefully you still have some documentation from that loan. However, they consider your second loan a totally separate loan and will not put any refund (which they will claim they don't owe you) towards that one. I ran into the same situation. I had to argue with them because they looked at is that I had the first loan - agreeing to their terms - and paid it - agreeing to their terms. So they then wanted to know why the hell I was fighting the second loan! So they will throw that in your face. They look at is as, you borrowed from us before on our terms and then you borrowed again and now your questioning us. Well, I argued I didn't know the state laws, that internet pdl's are illegal, blah, blah. Never heard from them again. Still trying to get responses, but that was my experience. It's almost as though you screw yourself if you get a second loan from one company. Although I would at least try to get a refund on the first one. But they'll argue your head off!

Thank you all...this has been a humbling excperience. But I definitely feel so much better. These last 2 weeks have been great!! I have my paycheck back, my rent is paid, I bought groceries...even had my kids over for dinner today!! I wrote letters all night and am happy that I had the info to do it!!
My dmp does include some of the pdls that were willing to make arrangements...however don't we know..the ones that refused are the ones I have over paid and/or no one can find. So I pulled them out and am working those on my own. Got a letter from my DMP today and according to the plan's budget I can be totally debt free in 11 months!!!! How thrilling is that!!! I love it.....

I am beginning to have this belief about those internet pdls that make it difficult to contact them whether it be by phone, email, or with a physical address, and here is my belief, screw them, if they want to make it so difficult to contact them, they must not want paid that bad after all.

The IPDL's got enough of my money. I was shocked when I figured out how much money I gave to some of these places. Then they had the nerve to demand more. Before I found this forum, I just didn't know any better. I believed I could go to jail which is a false statement.
