Sent pdl letter to One Click Cash. I have actually overpaid them according to my state laws. However, I received an email from them this morning. I have copied it on here. I'm totally freaking out now. Someone PLEASE advise!

This department has received recent communication regarding the above account. The communication received is recognized as portions of a form letter (cut and Paste template) currently being widely circulated via the Internet. Unfortunately this form letter is filled with misleading and incorrect information. The use of this form letter leads us to believe that there is not a specific complaint connected with the handling of your account. Please be reminded that the terms and conditions of the agreement you entered into with our company was presented to you at the time of your application and you were given a 48 hour window in which to cancel the agreement. In addition before each debit processed (within the guidelines of the agreement) you were given an account summary stating your options of fulfilling the agreement including instructions for repayment of the entire amount of the advance, in order not to incur additional fees. Since there is no mention of a specific problem with the way your account has been handled we must conclude your account was handled as agreed therefore your account will continue to be handled as agreed. Your persistence in this matter with us or any other agency that does not include an account of how your account was handled out of the guidelines of the signed agreement will merit the same response as the one you are now reading.

A copy of your electronically signed contract can be faxed for your review. If, after your review, you find your account was handled differently than was/and is stated in the agreement please forward those details at once so further review of your account can be completed. It is our earnest endeavor to provide the best possible customer service and customer satisfaction and miss-handled accounts will be researched and addressed immediately. Any Legal questions will not be answered; they must be placed in writing to our Legal Dept via Fax1-800-491-6913, your account will continue per the contract. You have not even paid the deposit amount back that we placed in your account.

Please also note, we are the original creditor, the fdcpa applies only to 3rd party collectors.

We appreciate the opportunity to respond to your concern.


Read my response to your other situation with the other payday loan company. Stand your grounds, do not be afraid, do not back down. This is their own bland cut and paste they have sent numerous other members. You are going to be fine, you just started the battle and you are going to win so long as you do not let them intimidate you with these emails. Don't back down, and if you over paid these clowns, fight them, do not pay back more than you legally owe, complain to the attorney general's office.

Thank you, TweedleDee. I'm so friggin paranoid! I know I've overpaid these people. And now that you've pointed it out, I do believe you're correct that they are using a "form" email to send out to many people. The actual way the email was formatted, etc., was the same for One Click Cash and US Fast Cash. Just different wording. I'm going to file my complaints tonight & then tomorrow re-send my documentation stating my state laws. Plus the fact that I owned up to owing US Fast Cash the money - just the max allowed by my state. So what's up with that?? Okay. You're helping me here, but I'm still freaking out! Thank God my new bank account is "unknown" and forever will be. Blood sucking theives and now they're out to give me a heart attack!

I'm filing my complaints right now with the FTC, the BBB, the AG, and also IC3. I will then RETYPE (so it's not a "form" letter) the idiots a letter stating my laws, rights, etc. But I figured I'm going to go ahead and file these complaints NOW since they scared the crap out of me! That way the wheels can begin. Then I'll do the same for the other smart-assed email I received. At least I'm not the only one who got the "form letter email" claiming I used a "form letter." Good Lord. . . .

I brought up the same point to them when I emailed them back. My exact words were "Funny I saw this exact same thing on a website, I find it funny that you make accusations that I am using a form letter when you are doing the same thing" then I restated my laws and rights. Never heard from them again. I think the smarter we get about how they work they the better off we will be.

I'm trying your tactic. I told them I'm finding it questionable that they claim I used a form letter when I believe they used a form letter via email regarding my loan. We'll see. I'm sticking to my guns and disagreeing and arguing. I told them not to send me any other threatening email, also. I'm emailing and sending certified mail.

yeah they also called me one day and told me I needed to set up an arrangment- I told them I needed to call them back that very same day they withdrew money via a made up chek overdrafted my account ao I called them back and asked what gave them the right to take money out of my account I didn't athorize. I talked to the exact same person I talked to the day before and he told me that that check was sent threw the day before he talked to me- so I asked him if that was the case what did he call me for saying I needed to set up an arrangment for? He was speachless. Well did the check go threw I said nope I rejected it- the bank sent it back. He said well then well just have to resend it- I said go ahead I just walked out of the bank and closed my account. And he hung up.

All my mailed correspondence to these jokers was just returned to me yesterday! All stamped NON DELIVERABLE/NO SUCH ADDRESS/NOT AT THIS ADDRESS. They have about 7 address & every one of them was returned because I sent my letters to every address I had. I believe they are related to MTE FINANCIAL, as is Quickest-Cash-Advance, which is another pdl I have out. Filed all complaints against MTE FINANCIAL with their 17 d/b/a names and 8 different addresses.

Haven't heard from them again since their wonderful email they sent me. Haven't heard from Quickest-Cash-Advance at all, and haven't heard from US Fast Cash since their wonderful email. They are all MTE FINANCIAL. So don't know what they're doing now. My phone has a lot of calls coming, but I don't answer. They'll probably turn me over to collections or whatever they do. I'm not contacting them again. I filed all complaints on them as thier "own" names that I have pdl's with AND ALSO filed complaints against MTE FINANCIAL as a whole with all their names, addresses, and telephone numbers. These people are amazing.
