Able to do this?

I am contacting you because you have one or more payday loans that have gone into collections. I have made numerous attempts to get in touch with you regarding repayment of your account(s). Since you have demonstrated an unwillingness to voluntarily settle the debt, you have been referred to Check Recovery. This automated system is actively looking to locate any valid bank account associated with your name and social security number. If such an account is found, Check Recovery will move to recover the entire balance due at once. If you would like to have control over how and when your loan(s) are repaid, please contact me to put a firm payment plan in place. If I do not hear from you by close of business, tomorrow, June 20th, I will assume that you would rather have my company take back what you owe rather than paying it back with reasonable terms. You may contact me by phone, fax, or email. Thank you in advance for your cooperation ----------------------------------------------------- |
Is a company allowed to do this?

I have a different bank account from when I first took out a loan from them. I am refusing any further payment to them, because I have paid them back what is legal in the state of Arizona. Either way, this is a brand new checking account.

Check recovery is a lot like teletrack . . . They really just compile other reports. Check Recovery doesn't actually collect, they are just a reporting agency. What they mean by taking your bank account is if another pdl reported you, they would compare info to see if you used a newer account. But even then, legally speaking they cannot get into said account without auhtorization or a court order.

Good. So do I need to worry about seeing a debit show up for something from my new bank account? Has it happened to others? Or, is this just a scare tactic?

I wouldn't worry too much . . . Unless you've taken out other pdl's since that have the new account info, then there would be a chance.
Just to keep all your bases covered, make sure you have letters revoking any authorization for these places to debit any account you have. Then if they try, at least you will be able to dispute with your bank and get the money back.
