oh snap! bank account NOT closed ????
Date: Tue, 06/19/2007 - 13:45
I know from reading on hear that it has happened to other people...Just wondering what my next step should be.
I'm dealing with Fifth Third bank in Ohio. All of my loans are Internet and none are licensed in my state. I still owe some money to most of them to pay the principle amount, but will be unable to pay them as soon as I thought if I am going to owe my bank all these fees. Also...can Fifth Third take legal action against me for these fees if they are not paid right away?

Your bank will eventually close the account, and if you do not make arrangements to pay the overdraft, they will report you to Chex Systems. Listen, you need to go online and file complaints against each one with Ohio's Attorney General's Office, can be done online. Next, you need to go elsewhere and open a new account before you are reported to Chex Systems.

I opened a new checking account with another bank before I closed this account so I wouldn't have a waiting period without checks and/or a debit card.
I was just wondering if anyone knows how long it will take them to close it since they are charging me daily.
Also, I read somewhere that if they do report me to checksystems that they can take over my new bank account and take any available funds. Is this true?

No. Usually a bank will leave the account open for 30 days and in that time charge you whatever fee the bank charges, in your case $6/day it is overdrawn before they close it. After that time, you don't make arrangements they report you to Chex Systems and begin collection activities. Now, if you had a savings account with this bank that you are overdrawn with, they can take money from your savings account and apply it to your overdraft fees.

Yep, 30 days for the account to close is normal . . . . And if the amount isn't paid, the bank can proceed with collection activities, including suit, so calling them and setting up a payment plan is the good idea.
Also, explain your situation and see if they can put some sort of block on the account to stop the bleeding.

Did you go see the branch and explain that because you revoked the ACH priveledges that these withdrawal were fraudulent and should be reversed? If they are uncooperative I would file a complaint with the OCC against them. The Office of the Controller of Currency is the federal watchdog over National Banks. This was not your fault. You took all the steps to prevent it and the bank allowed it anyway. I think you have a case there. No bank likes the OCC coming around.
Oh, and by the way . . . Regarding being reported to Chexsystems
Oh, and by the way . . . Regarding being reported to Chexsystems - Just going out and opening a new account before you get reported doesn't always work. Most banks that use chexsystems will run sweeps on new accounts for the first 3 to 6 months. When they find the report, they will freeze and close the new account. You will get your money, but in 6 to 8 weeks . . . . So if you are worried about chexsystems, go to a bank that doesn't use it at all. If you want to PM me I can help you find one in your area . . . .

Thanks all. I guess my first step is going to be to call the bank and explain that I CLOSED this account for a reason. If they cannot reverse the ACH charges, I will repay them, but I should definately not be liable for the overdraft charges.
Now until then I will just be worried about my new bank account. If they were to keep my money for 6-8 weeks I would be devistated.
My new bank is US Bank and I'm sure they use chexsystems.

If need be, take a copy of the letters you sent to each company showing that you revoked authorization to debit your account. I would do this as soon as possible. They may be able to reverse the actual charges, not sure about the NSF fees, but I would try. Also if you do not get the answers you want from talking to one person, go to a higher up until you get satisfation.

US Bank does use chexsystems, and may still do sweeps. I'd recommend to you to not keep all your money in that account until you've had it for at least 3 months. After 3 months the chance of them doing a sweep and finding the chex report goes down drastically.

Many times an account will show negative the amounts presented and then credit them back when they are returned. This takes a couple of days sometimes to show on your online statement. Could this be the case?

Defiantly follow the advice about going to your bank with those letters. If you revoked authorization to those places, they had no right to make those debits.
