As you can see, payday loans are prohibited in your state. File a formal complaint with your attorney general. Send a letter to National Opportunities/itsmypayday, telling them they are operating illegally in your state, inserting your state's laws. Also let them know you have filed a complaint with your AG. Since they are not legal in your state, you morally only need to pay them back the principal that was borrowed. Good luck.

Another thing you can do is fax a copy of your state's payday loan regulations. That is what I did after I had no response to my email. Their fax number is (800) 243-7520. The next day a rep from the company called and stated that they would tell the BBB that they would write the remaining balance off and tell the CA to get off my back. I even owed them about $100 but they decided to write it off. Good luck to you!

They totally ignored me. Faxing/emailing/mailing. Just totally ignored me and kept trying to debit my account. Then I filed complaints. Today I received my ONLY reply from them and it stated that my loan was "written off", my balance is zero, and the issue has been resolved. Okay. Well, it apparently wasn't anything I did! LOL! They ignored me! So FILE YOUR COMPLAINTS WITH EVERY AGENCY! Apparently it lights a fire under thier butts!

They did the same with me, well kind of. I did hear from them but they were very threatening to me in the beginning. They were the first harassing phone call I received from an IPDL. I will never forget that. The guy treated me like dirt so I guess you are kind of lucky that you didn't have to experience that kind of phone call. I received e-mails from their collections department after I signed up with T & C. They too wrote off my balance after I filed complaints against them. I handled everything through my AG's office and kept correspondence on everything.

I found a variety[/FONT] information that has truly enlightened me to this industry as well as the "stigma" surrounding it!
1. National Opportunities Unlimited (itsmypayday.com) is an approved lender for "payday loans" or "micro loans" in the State of New York, so they haven't broken any laws by lending to you (as stated in a previous post).
[SIZE=2]2. The bigger issue seems to be, that there is a communication void regarding your loan, payment status, banking information and/or ACH (draft) discrepancies. [/SIZE]
[FONT=null][SIZE=2]3. What happens when you "stop payment" on your bank account, and the lender tries to draft you:[/SIZE][/FONT]
[SIZE=2][FONT=null]a. Your bank sends a notice to the lender,[/FONT][FONT=null] a "notice of correction". This notice is to inform the lender that your account will not be able to be drafted for payment and it's up to the lender to try and contact you (BY WHATEVER MEANS NECESSARY) to find an alternative method of payment.[/FONT][/SIZE]
[FONT=null]If the lender is unable to contact you on the phone, they resort to sending multiple e-mails a day (not considered spamming, by the way), calling your home and work all day long and in some cases texting your cell phone! [/FONT]
[FONT=null]b. Understand that most of this attempt to contact/communicate with you is AUTOMATED. The e-mails are generated by their system, sending every 1 or 2 hours. The same generation process for text messages.[/FONT]
[FONT=null]The phone calls are usually auto-dialed, and when you answer, the customer service person is there![/FONT]
It's totally understandable that you would stop all transactions against your bank account for fraudulent activity, however it is your responsibility to communicate this change to your lender.
FYI - 1: If you want them to stop "harassing you", via e-mail, messages, phone calls to your associates, the best thing you can do is Call Them Directly! These lenders are more interested in being paid back. It's in THEIR BEST INTEREST to help you resolve the debt. In a lot of cases these lenders will "forgive" your fees just so they can get your account current and in good standing! All you have to do is ASK THEM TO FORGIVE THE FEES!!! They WANT you to be a good customer. They WANT you to be a returning customer. They DON'T want to send you to "collections". They rarely see the return on the payments you owe if the account is passed to collections.
FYI - 2: Because of the "type of loan" this is, EG: Payday Loan or Mico Loan, they don't typically report the defaulted payments to the credit reporting agencies. I asked National Opportunities if they report to credit bureaus" and they DON'T!!! I was surprised that they don't report the default, but it was explained to me that all they really want is for the customer to make good on their loan, and be a future returning customer. They would forgive most if not all of the fees they threaten you with.

2. You're incorrect. All payday lending is prohibited in the state of New York.
