How many times can a debtor call your relatives/friends?

Cashcall has called my sister twice this week and my best friend once. I have heard they are only allowed to call one time in order to location the borrower. Is this true?


The law says a debt collector may only call a third party for location information once. The exception to this rule is if the debt collector has reason to believe the information provided is incorrect or misleading (the third party attempts to throw the collector off the trail) then the collector may legally call back. But once the collector have your location information, they have no legal reason to call a 3rd party; doing so violate this section of the fdcpa.

According to the Fair Debt Collection Practices Act, a debt collector can not communicate with a third person more than once. However, if the debt collector genuinely believes that the third person is deliberately giving false or incomplete location information, then he might phone up again to get the correct information. In my opinion you should phone up Cashcall or mail them to sort out the matter.

So, does this include family members? I know of a collection agency that contacted the grown daughter of an individual(who lived across the country) three times . They told her that she was put down as an emergency contact number; when she asked what the emergency was they told her they couldn't disclose it. They never asked her the parent's location or phone number just harassed and escalated during the call. They never identified themselves as a collection agency. Is this illegal?

i had a similar experience they called my sister n law, (must of been searching in the phone book or something i was at work) told her there was a medical emergency and that they needed to get into contact with me. She thought something happend to my son, so she gave them my mothers number and they called her and proceeded to tell her all my personal financial situation, that they were going to sue me and attach my wages. I was told later this is very illegal and that i could have had a lawsuit myself on them. The same people would call me after hours like 10-11 at night and so forth.
