Usually when people like WW&R learn that you have an attorney, they realize the odds are against them, the same with most CAs.

They are suing me now, their validation process was not satisfactory to me, after 3 certified letters, they sent me a bs affadavit, I challenge it and have not heard from them since I requested that the individual that says he has first hand knowledge and swore to it under affadavit, show up and testify. They initially filed suit against me in December 06, after many challenges I have not heard from them since March or april. How many people do you need to file a class action?

WW&R work on a commission of what they collect and judgments they are able to obtain. Consumers are urged to vigorously defend any suits being filed by challenging the validity of their documents. Many WW&R court filings result from defendants failing to show; (always the wrong move). Always respond to a suit, show up in court, and challenge everything.
Debt buyers typically file suits that may be out of statutes, have improper pleadings, contain manufactured affidavits, and have no trail of ownership.
Any of these facts may be useful in a defense, which is why is it wise for anyone dealing with a bottom feeder litigator to respond aggressively, on time and armed with information.

Looking at what fedupinpa has posted, it seems that this is spot on accurate for them. Be sure to ask any questions you have here, we will do our best to get you answers. The best thing you can do is do your homework. Learn the fdcpa like the back of your hand, so you will go into this armed with all the knowledge needed to put them in their place when they are sloppy or when they try to circumvent the law's requirements. Very good thing to do, getting that lawyer on your side. That will help immensely.

I just got two letters from them today dated june 13,2007 giving me 15 days to resolve the debt.The envelope is dated june 20,2007....mmmmmmm....sounds like they are trying to confuse the date.I called my attorney she said they are sleazy and :wink: their tactics are

karenr216, let us know if your attorney has the case granted class action status. I'm sure you would find a large number of people indeed who would join in, just on this forum. As to your letter, it sounds a bit like overshadowing (another violation) to me, ask your attorney.

The court held that by doing this, without explaining how the tack on fees and interest were calculated, made the dunning letters confusing to "the least sophisticated consumer" (as in the fdcpa). So there was at least two violations without proper validation.

Hey can anyone help me with these jerks? They actually "served" my brother on my behalf??? with court papers as they are suing me from a Capital One debt but the papers I need to turn back into the court saying that I'm gokng to appear, aren't even there!!! They weren't included as they were supposed to be and now I have to contact the court to find out how I get them???? I have saved EVERYTHING I've ever gotten in the mail from these people so can someone tell me what exactly to look for in my mail that I can get them on as I plan on appearing and defending myself...Thanks for all your help!!!!

Read the previous posts that law student wrote- may be something there you can use. Also, the fdcpa can help you know it and apply it to what they have done- or not done.
I'm not sure I would appear and represent myself unless you really know procedures and what to look for that they may have done or not done!

Something else, the also work for LVNV, who has broken many regulations, but do sue- hoping people won't show up, not know their rights, etc.
Also, file complaints with your AG, and the BBB. I looked up LVNV a while back and they only had a few complaints :shock: They should have dozens and dozens!!

A Little Note
I can understand why the dates may be off on the letters. The paralegals at Weltman work off of word templates. This is a pre-designed format that the employee tabs to certain areas to be filled in. This includes the dates. If the date was June 1, 2007, and today is June 01, 2008, then the paralegal forgot to change the date in the template. As a former employee, I understand your frustrations. Remember, Weltman was hired by the creditors to get their money from the debtor. That is their business. I did not always agree with their tactics, but they were legal. As for how many people handle each case, it varies, but usually it's 2 or 3. The attorney in charge of the case and the paralegals that do the paperwork. Weltman, Weinberg & Reis take very good notes and they are visible to all employees. If you phone them, trust me, they documented it.

I tried to negotiate a consent judgment with them only to have them give me some unreasonable payment amount and terms just to get me to miss a payment and end up in default anyway. I have hired an attorney to answer my summons. They're intent is to get the summons dismissed. I'm terrified that no matter what my attorney does, WWR is going to fight back and win.

I was sued by W.W.R and the sheriff came to my door with papers. I contacted them to make payment arrangements and they told me when the court rules against me, they would send me the papers. I received the papers but no information on where to send my payments. I now received a letter saying that I have 14 days or they can auction my personal property and garnish my wages. Is this for real because I don't know after reading this forum. Can someone answer as soon as possible because I cannot afford a lawyer and I need to know if this is for real. Thanks

You need to get a lawyer no matter the cost. It will be well worth it. You have to remember that you need to protect yourself and your rights especially with the FDCPA. No matter how much you are educated on the subject, there's a lot more a lawyer can do to help you.

Just curious as to why everyone gets mad at collectors debts that YOU do owe? If i have this right person A owes corporation B money, person A does not pay, corporation B retains law firm to get their money back, person A files suit against the law firm for money when originally it was person A who owed money? I think that sound sleazy actually.

Would you rather not be informed then just get served a summons or would you rather be called and given a chance? And if you treat the person like crap when they call why would they be inclined to do anything for you? Collectors good or bad will always get a bad rap, its the nature of the business I guess. As a former collector there I received numerous Christmas cards from people I helped. Owing money is never fun and its sometimes hard to deal with thats why people reach out for help on these forums. FDCPA or FCRA aside its still the principle...you could say the guy who sold you your cell phone scammed you by charging you more then the next guy but ultimately it is YOUR fault for not knowing the deals(rights).

Because lets be honest and real majority of the time this is the case. On a wider spectrum collecting this money back for the creditor keeps costs down on everything you buy. I am not making excuses because some C/A are down right awful and bottom feeders...but to complain about creditors wanting you to pay what you are obligated to pay, complain that the balance is now double what it was a year ago, complain about a collector being rude to you when in reality the debtor is most likely cussing you out for what is their own fault...this is what happens when you complain and do nothing and expect to bury your head in the sand and act like nothing happened! I came here because I find it hilarious how angry people get when they are in debt and just want to deflect their problems. I thought I was in a unique position to offer some hindsight into how to handle debt issues. Like moderators on this site should do...instead the only answer you get is to slander the companies. Help people by informing them of their rights, how to request information, how to negotiate settlements, etc. And at times you most likely have...but calling all collectors bottomfeeders/sleazoids what does that accomplish?

People here do give good info. However , there are a few who think that slandering companies and people who do not adhere to their beliefs is the only info to give. I disagree with that. Name calling and slander do not help.

I haven't been coming to this forum for long but the advice that I have gotten and been able to give myself has not been on how to get out of not paying but making sure that who you are paying is the correct company. yes like most place you can get good and bad advice. All I have seen here is people trying to educate others on how to deal with companies that start out by using illegal methods on collecting money. I recently found out that someone I almost started to pay was just doing a scam when I contacted the original creditor they still had my account they haven't sold it off because I have been paying them. I wouldn't have know that they were a scam if I hadn't come across this site. I see this site doing more good than harm. that's my opinion. And Paul has given me some good advice and things to watch out for.

Thank you for your valuable comments. But I will say that the Moderators do not give bad advice, that is why they are chosen to be Moderators - despite the slanders of our troll friend - because of their consistently solid advice. Most of the bad advice I have seen comes from anonymous posters, and much of it has been countered by a regular and registered poster. We can't catch everything, unfortunately. Sure, some of us mistakenly post imperfect information, but from what I have seen we are ready to stand corrected if someone has evidence (i.e. references) showing that we are wrong. I'm sure Mr/Ms Advocate has made mistakes in their life, too. The Moderators are humans, each with their own personality. Friendships are formed here in the Community, but that is not it's primary purpose/function - that is to educate and empower everyday people whose only crime is to be temporarily caught within the jaws of fate.
It's difficult enough to be in debt, but it's more difficult to tolerate such criminals and humanoids as many of these collectors hire - and will continue to hire, as long as people do not know their Rights under the Law.

I just received a civil summons from these guys on behalf of Capital One. I don't wany any sympathy from anyone and I do know this is my debt but I'm in a bind financially along with many Americans. I know this can't be used as a defense so I'm going to try to exert my rights and see where how it plays out. Does anyone have an example of an answer to a civil summons? I found one but it's pretty lengthy and asks WW&R to produce a ton of documents! I'm also going to ask that they validate the debt. Capital One is listed as the plaintiff so I'm not sure if WW&R is a 3rd party collector or not. I'm asking for proof that Capital One has given them permission to collect from me. There is no disclaimor on the summons that says this is an attempt to collect a debt, etc.
I'd appreciate any advice on dealing with them and any examples of answers to civil summons for credit cards. I live in Northern KY, just south of Cincinnati.

Okay, so I understand what you are going through. They claimed they took me to court a couple of years ago. After getting a letter about garnishment I can the court and Legal Aid which both told me to file two motions. One I responded that they did not serve me and illegal signed my name on the Proof of Service papers and two they were trying to garnish a bank account that was not legally mine on top of my State Taxes. Anyway, I took them back into court and some representative of theirs was there who tried to act like he knew something, not. When he tried to talk to me he immediately had this attitude that we were not going to be able to negotiate. I told him we would take it back into the court room for the judge to decide because 10% of what they claimed I owed was nothing and that they are trying to overcharge me by 6 times the amount that I technically owe. Anyway, a--hole judge and she allowed them to get some of the money and awarded the full amount. I told the man that him and all the rest that do people wrong were going to burn in hell. Afterall, I don't mind paying what I owe but I refuse to pay anything else. I believe the Statue of Limitations were running out. So, I left court with the mind that once I found a job I might file bankruptcy just so these a--holes cannot get anymore money. I would rather give that money to bankruptcy then some jerks. I was pissed and even signed up with some company that if there happens to be a class-action lawsuit brought against this company they will let me know. Anyway, about a month - two months went by and I did not hear anything until one day I got a check from these jerks that was for a refund due to overpayment. This company is very unorganized a don't care about people. One thing I would suggest is if you have any documents take what you can to court with you to prove how much you owe versue how much they are charging. Even though I had an a--hole judge I let her know that I did not even owe my credit limit when I stopped paying and that I had the payment protection plan on my credit card but the credit card company claimed I did not qualify for it. This was another thing that pissed me off. She did not even care to look at my documents, but what goes around comes around and she will need something one day and be sh-- out of luck. Sorry, for the long story hope things work out for you and that you get a decent judge. Good luck and rememeber before going to court gather as much evidence as possible. Oh, another thing that I told this company is that I knew that they had been shut down in two states and had numerous complaints and law suits against them (Better Business Bureau) from my state and theirs (Ohio). So, where ever you are from check the BBB in your state as well. Remember print out what you can. Again, good luck.

In any case, it is nice to know that people can voice their opinions or let out some steam or frustration and know that not all people will judge them. It is everyone's right to formulate their opinion or express their feeling without some jerk complaining. I say to all who don't like what people say about these companies, get the hell off the forum board and find people who think like you and form your own group of opinionated jerks.
