Mutual Release Agreement

Here's my question - If you signed a mutual release agreement with a PDL where it states that "the company" fully releases and forever discharges the borrower from and against any and all claim, debts due, sums of money.....etc..... Then doesn't that mean you are "released" from the loan amount?? This pdl still wants $300; however, after reading over the agreement for the 100th time, it says the borrower is "released". It also states that the agreement supersedes any and all prior agreements. So - to me - unless I'm insane - means that I am "released" from the loan from them. That this agreement "wipes out" anything and only go by the agreement, which states I am "released". Am I correct or crazy??? I'm sitting here thinking - Why the hell would I mail them $300 when this document states I have been "released" and it "supersedes any all prior agreements? IF ANYONE HAS ANY EXPERIENCE OR ADVICE ON THIS - PLEASE HELP!


Cannr, I received a release (settlement agreement) yesterday that had a clause like that in it from payday2go, however, I also received a payment statement from them with the final payment posted as $500 waived. But I signed the agreement because the way it reads is that you are "discharged aginst any and all debts due, claims, sums of money, etc."

That's what's confusing me, blfow. I got an email from them and it says they will take payment of the max allowed by law for my state (even though internet pdl's are illegal!) and then sent me the agreement. According to MY records, all I have is an email wanting $300 to "call it even" (basically) and then sign the agreements. Well, I didn't get any "official" statement from them with a payment amount or discharge amount or anything. Just the email (whoope!) which was dated BEFORE the agreement. And according to the agreement, anything PRIOR to the date of the agreement is pretty much "blown off". So.........I'm thinking - Okay. Do I really need to send them $300? They released me from the loan. The agreement was dated AFTER the email regarding $300. I didn't sign anything regarding $300. Just the agreement. Do I need to WASTE MONEY I DON'T HAVE sending it to these people?

I wouldn't send them any money. It sounds to me like they are closing your account, but I could be wrong. I am sure that someone with more knowledge in this area will be around soon and answer you. i saw that Cajun and Anthony were areound earlier- maybe one of them will know what to tell you or someone else with the experience.

That's what I'm thinking. The agreement states they are releasing me. Okay. I'm released. So now why would I send them money? If Cajun or anyone else is on here, or anyone else who has knowledge of this, please post. I'm still sitting here staring at this agreement thinking I don't owe them any money since it's signed. Thank you!!!!!

I can see all sides here. Half of me just totally agrees with Leah. But then I keep thinking, do they mean I'm released AFTER the $300.00? Nothing in the agreement has a dollar amount. It just says I'm fully released of all debts, blah, blah - I can't do business wiith them, blah, blah. I could try to call them; however, dealing with these people over the phone has been harrassing, so I only deal with them via email. If I'm lucky, they respond. If I don't give them money, will this agreement "stand up" and "take over" because it says they're releasing me? (God, it sounds like I'm in jail! LOL!)

I wouldnt give them a dime more. Also please print out that e-mail and send to your AG. I signed several of these agreements and sent them in to AG and I got refunds. KYSIDE38

Thanks, kyside. I think that's what I'll do. I just hate to hand over $300 when I've signed this agreement saying I'm released of all debts! Should I just do the "complaint form" and send a copy of the agreement and the email to the AG?? Or send everything under the sun??

cannr, Send anything that you have that relates to a complaint to the AG. They need all of the evidence they can get. They will take care of it. KYSIDE38
