I was on a joint account with my younger brother with wachovia in 2005. I barely used the account, the account is now overdrawn by 1612. The collection agency MRS associates now have the account. I called them a few months and tried to get a settlement offer of 700, but they refused so the guy was like they would probably settle for 1000. I know for a fact they only paid pennies on the dollar for the account and i do not want to pay them the whole amount. It is reporting on my credit report, but with wachovia. I called wachovia and they said i had to deal with the collection agency. I want to get this account paid becasue i am planning on buying a house in the next year or so, any ideas on maybe how i can get them to settle for less than 1000?


Is your brother also paying on the debt? If he agrees to pay a portion, you will have less stress on this payment.

Have you got the debt validated by MRS associates? Make sure that you are proposing your payment plans to the right company that has your debt information. Keep pushing with your payment plan. If they really want to get paid, they will be ready to work on your terms sometime later. Keep in contact with Wachovia Bank also if they are ready to work on your terms.

Since this is a collection call, you can have it recorded also. Check the laws in your state whether you need permission from both the parties. This recording will be an important proof of your settlement process apart from the written agreement.

Since you are a joint holder,they can hold you responsible for the entire amount. Have them validate the account with a dv letter sent certified return receipt. Once validated start sending offers to settle your account and wait until they agree with what you wish to pay.If you pay the account,ensure you pay with a money order and that they give you a paid in full receipt.Since this is a checking account you may want to check your chex system report since the bank has probably already reported you for a overdrawn account.This will make it difficult to open checking accounts.

How did you go about paying or negotiating an MRS Associates settlement offer? Did you just pay from their collection notice, or did you have an agreement of some sort? Verbal or written? How did you pay them, and how long ago?

The problem with MRS is that they're basically scum with delusions of respectability. Once they've got your money, they don't know you.

i had a debt with bank of america for my credit card and i was delinquent for two years since 2007. they (MRS) called be in october of 2009 and said that i had to pay the full 1001 (yes that does say 1001) and i said no way in hell cause i was still in college full time finishing up paying for school and graduating and working full time to pay for my car, car insurance and other expenses. He had asked me why i thought paying my other bills were more important than this credit card and i said because i need a car to get from point a to point b and to go to work so i can pay my bills and without a car i cant do either. I told him that I was willing to settle for 600 and first he said it wasnt possible. So being the smarty pants that I am said to him .. look man i know you're just trying to do your job, but you have to understand that it is not financially possible for me to 1000 right now because im barely making my current payments as it is so either you want to settle or you dont. because if you dont settle with me we both end up losing, you wont get your money and my credit keeps getting worse, so whats it going to be. and he finally said OH! well seems like i missed some information .. BoA is willing to settle for 3 payments of 225 a month for october, november and december which is a total of 675. I said that it was fine and we settled. I am making my final payment this month on the 30th but in order to accomodate this debt i was reluctant to pay my 350$ car payment so after taking me seven months to catch up on my payments, i am now behind a month to settle this debt. Honestly, better late then never because the harrassment calls will keep on coming and coming and they will not stop until they get their money. What they are doing is in fact illegal under some collection payment laws.. They might not settle for half of what you owe but you will settle for a significantly lower amount that what you owe.

you have to be smart and cunning with these people. they have feelings too and they also realize the financial hardships that are plaguing this country. EVERY ACCOUNT has a settlement offer. Ive done it before and it works. Just tell them you can afford monthly payments have they take it directly out of your bank account. GET IT IN WRITING because if they exceed the amount you settled for then its a breach of your agreement and they can get sued (by you.)
