I have a debt that is being handled by SIMM Associates out of Delaware. I am soo fumed by this one collector, Stephan Woodruff. I just called there to speak to him.. and did ask for a debt validation.
He lied at first when I asked what his last name was. He told me Wilson and I told him he sounded alot like the guy that keeps calling me at work harrassing me. He then told me it was him and when I asked why he lied to begin with about his last name.. He changed the subject. He said he basically can still call me until they receive something in writing from me.. To which I responded I fully intend to send him such a letter. I also told him I will report him to the FTC if he continues with the harassment. The calls to my job irk my boss to no end. I can't pay the debt if I don't have my job.. :evil:


Next time when you talk to this person, stand tall. You don't need to keep yourself worried if he is not following the laws. fdcpa clearly mentions that all debt collectors must validate the debt in writing before doing further collections. Send your DV letter to their mailing address through certified mail, return receipt requested. This will be one legal move from your side to ensure that you have every intention to pay the debt. If they don't send you the details and keep contacting you, send a full cease and desist letter and stop them legally from contacting you. If necessary, record the phone calls after checking your state laws. Build up more legal proof of their violations and sue them with the help of an attorney.

Well, it's people like you that drive up the costs of living in America. If more people took responsibility for their actions, and paid their bills..I doubt as Americans wouldn't have to pay for it. I pay all my bills and probally make less than most people in debt..then you people come on the internet and complain about a collection agency harrassing you? Honestly, they need to eliminate bankruptcy all together..and allow creditors to file for wage garnishments in every state...that way people would be forced to pay their bills. After all, I pay my share..and I' have children..so what is your excuse?

PerfectCredit would have us to return to the Victorian "work houses" of old England (ever read Dickens?). Or to the European concept of having creditors declare -you- bankrupt, and move in on whatever assets you might have. No, this is not an American idea that this person posted. Not to be personal, but this person also has no respect for states' rights.
